A RESOLUTION OF THE BOROUGH ASSEMBLY OF THE KODIAK
ISLAND BOROUGH VACATING LOT THREE (3), BLOCK ONE (1) MILLER
• POINT ALASKA SUBDIVISION AND APPROVING A RE -PLAT THEREOF INTO
LOTS THREE A (3A) AND THREE B (3B), BLOCK ONE (1) MILLER POINT
ALASKA SUBDIVISION
WHEREAS, WELFORD H. SMITH has petitioned the
Kodiak Island Borough Planning and Zoning Commission for the
vacation of Lot Three (3) Block One (1) Miller Point Alaska
Subdivision and the re- platting of the same into Lots Three A
(3A) and Three B (3B), Block One (1) Miller Point Alaska
Subdivision and it appearing that with the re -plat, Lot Three A
(3A) will contain 1.71 acres more or less, and Lot Three B
(3B) will contain approximately 2.00 acres and there is a
20 -foot wide utility easement dedicated between the said
lots and they would therefore conform with the comprehensive
plan adopted by the Kodiak Island Borough, and
WHEREAS, all persons interested were notified that
a public hearing would be held on said Petition on Wednesday,
January 27, 1971 at 7:30 o'clock p.m. in the.District Courtroom
of the State Office Building before the Kodiak Island Planning
and Zoning Commission, which public hearing was duly noticed
and held, a copy of the Affidavit of Publication having been
it
filed herein and at which hearing the Planning and Zoning
I Commission recommended that the above- described Lot Three (3)
'Block One (1) Miller Point Alaska Subdivision be vacated and
,ire- platted as Lots Three A (3A) and Three B (3B), Block One
(1), Miller Point Alaska Subdivision, and the Kodiak Island
,I Borough Assembly being fully advised in the premises;

NOW, THEREFORE, BE IT RESOLVED that Lot Three (3)
Block One (1) Miller Point Alaska Subdivision be and the same
is hereby vacated and re- platted as Lots Three A (3A) and
Three B (3B) of Block One (1) of the Miller Point Alaska
Subdivision pursuant to the subdivision plat prepared by
Roy A. Ecklund dated December 18, 1970 in accordance with
Section 40.15.140 -180 of the Alaska Statutes and that the
Kodiak Island Borough accept all streets, alleys and easements
and other open spaces dedicated to public purposes as set
forth in said re -plat.
