RESOLUTION NUMBER 70- 27 -R
A RESOLUTION OF THE BOROUGH ASSEMBLY OF THE KODIAK
ISLAND BOROUGH VACATING A TWENTY -FOOT ALLEY IN THE ALLMAN
ADDITION TO THE CITY OF KODIAK
WHEREAS, JAMES GAROUTTE and MARY GAROUTTE have
petitioned the Kodiak Island Borough Assembly and the Kodiak
Island Borough Planning and Zoning Commission for the vacation
of a twenty -foot alley in the Allman Addition, and
WHEREAS, as a basis for said Petition the Petitioners
stated that said alley lies and exists between Lots Twenty -one
(21) and Twenty -two (22), Block Two (2) of the Allman Addition
to the City of Kodiak and that they were the owners of a
majority of the front footage of the property lying and being
adjacent to said twenty -foot alley, and that said alley is a
platted alley but is not in fact in existence as all of it now
exists on Lot Twenty -two (22) which is owned by the Petitioners
and the Petitioners are also the owners of Lot Twenty -one (21);
and that there are three (3) other means of access to other
areas of Block Three (3) besides the aforementioned alley and
the same is not necessary in any respect for the use or
1 convenience of any property in the area and the vacation would
j not inconvenience any other property owners as all surrounding
,' property has other access, and
WHEREAS, all persons interested were notified that
I, a public hearing would be held on said Petition on Wednesday
I, the 28th day of October, 1970 before the Kodiak Island Borough
� Planning and Zoning Commission, which public hearing was duly
noticed and held and a copy of the Affidavit of Publication
I. ▪ having been filed herein and at which hearing the Planning and
II Zoning Commission recommended that the above - described alley be
!', • vacated and the Kodiak Island Borough fully advised in the
premises;

NOW, THEREFORE, BE IT RESOLVED that the twenty-foot
alley between Lot Twenty -one (21) and Twenty -two (22), Block
Two (2) of the Allman Addition to the City of Kodiak, which is
a platted alley but is not now in fact in existence, but instead
is in existence on Lot Twenty -two (22), be and the same is
hereby vacated and that a copy of this Resolution be filed
with the Kodiak District Recorder for notation to be attached
to said Plat, indicating the portion of the above - described to
have been vacated in accordance with Section 40.15.140 through
40.15.180, Alaska Statutes.
PASSED AND APPROVED this 10th day of November, 1970.
