RESOLUTION NUMBER 70 -21 -R
A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY
PROVIDING THAT AT THE GENERAL BOROUGH ELECTION TO BE HELD ON
TUESDAY, NOVEMBER 3, 1970, THERE BE SUBMITTED TO THE DULY
QUALIFIED ELECTORS OF THE BOROUGH THE FOLLOWING PROPOSITIONS:
PROPOSITION NO. 1:
"Shall the Kodiak Island Borough, State of Alaska,
incur an indebtedness in a sum not exceeding FIVE MILLION SIX
HUNDRED AND EIGHTY THOUSAND and No /100ths ($5,680,000.00)
DOLLARS and issue general obligation bonds in said amount
for the purpose of constructing basic educational high school
facilities at Kodiak, together with appurtenances, swimming
pool, auxiliary space and site development necessary for said
structures, and construction of an Elementary school building and
multi - putpose unit at Ouzinkie, Alaska, together with
appurtenances, auxiliary space and site development necessary
for said structures; and pledge the full faith and credit
of the Kodiak Island Borough to payment of any indebtedness
so incurred and issue general obligation bonds with interest,
payable semi - annually and maturing within twenty -five (25)
years or less, all as is authorized by the Statutes of the
State of Alaska and provided by Resolution No. 70 -21 -R of
the Kodiak Island Borough passed and approved the first day of
October, 1970.
PROPOSITION NO. 2:
"Shall the Kodiak Island Borough Assembly have the
power to levy and collect a consumer's sales tax not exceeding
two per cent (2%) of the sales price on all retail sales,
on all rents, and on all services made within the confines of
the Kodiak Island Borough and the revenues derived therefrom
to be used for and applied towards the retirement of any
bonded indebtedness for bonds which may he sold by the Kodiak
Island Borough for the construction of the new schools in the
Kodiak Island School District."
WHEREAS, the Kodiak Island Borough, State of Alaska,
is duly authorized to issue general obligation bonds payable
semi-annually by virtue of Section 07.15.030 and Section 07.30.010
of Alaska Statutes, and
WHEREAS, the Constitution of the State of Alaska
provides that no debt shall be contracted by any political
subdivision of the State, unless authorized for capital
improvements by its governing body and ratified by majority vote
of those qualified to vote and voting on the question, and the
Statutes of the State of Alaska provide for the qualification of
voters voting on the question of incurring bonded indebtedness;

NOW, TfEiRREEEURE, BE TT RESOLVED by the Borough Assembly of the
Kodiak Island Borough, State of Alaska:
Section 1: That at the General Election to be held Tuesday,
November 3, 1970 between the hours of 8:00 o'clock a.m. and 8:00 o'clock p.m.
Standard Time of that day, there be submitted to the duly qualified voters of
the Kodiak Island Borough, the following propositions, to -wit:
PROPOSITION NO. 1:
"Shall the Kodiak Island Borough, State of Alaska, incur an in-
debtedness in a sum not exceeding FIVE MILLION SEC HONORED AND EIGHTY THOUSAND
and No /100ths ($5,680,000.00) DOLLARS and issue general obligation bonds in
said amount for the purpose of constructing basic educational high school
facilities at Kodiak, together with appurtenances, swimming pool, auxiliary
space and site development necessary for said structures, and construction of
an Elementary School building and multi- purpose unit at Quzinkie, Alaska,
together with appurtenances, auxiliary space and site development necessary for
said structures; and pledge the full faith and credit of the Kodiak Island
Borough to payment of any indebtedness so incurred and issue general obligation
bonds with interest, payable sari- annually and maturing within twenty -five (25)
years or less, all as is authorized by the Statutes of the State of Alaska and
provided by Resolution No. 70 -21 -R of the Kodiak Island Borough passed and
approved the first day of October, 1970."
PROPOSITION NO. 2:
"Shall the Kodiak Island Borough Assembly have the power to levy
and collect a consumer's sales tax not exceeding two per cent (2%) dt the sales
price on all retail sales, on all rents, and on all services made within the
confines of the Kodiak Island Borough and the revenues derived therefrom to be
used for and applied towards the retirement of any bonded indebtedness for bonds
which may be sold by the Kodiak Island Borough for the construction of the new
schools in the Kodiak Island School District."
Section 2: The manner of conducting and holding ai&' election
and detail thereof shall be in accordance with the requirements of the State
Laws and the Kodiak Island Borough redo of Ordinances and. Resolutions, and the
Resolutions of the Kodiak Island Borough pertaining to bond elections where
applicable or procedurally adaptable for the purpose of approving or rejecting the
authorization of indebtedness and the proposed bond issue, except as hereinafter
specifically provided. Each ballot shall set forthe the above propositions as
set forth in Section One hereof and the proposition concerning bonded indebtedness
shall be followed by the following words.

consumer's sales tax shall be followed by the following words:

Together with special instructions as the manner in
which the ballot shall be marked.
Section 3: All duly qualified voters of the Kodiak
Island Borough according to the Laws of the State of Alaska and
Code of Ordinances and Resolutions of the Borough shall be
1 eligible to vote at said election.
Section 4: The polls of said election shall be open
during the time prescribed in Section One of this Resolution and
the polling places for said election shall be as follows:

The boundaries of all Precincts are as defined in
the Alaska Administrative Code 6AAC59 Section 336 through 345 and
in the Ordinances and Resolutions of the Kodiak Island Borough
and the Emergency Regulations of the Secretary of State.
Section 5: The Clerk of the Kodiak Island Borough
shall issue and cause to be published and posted a public notice
of this election in the manner following:
(A) A copy of the notice prescribed by this Resolution
shall be published in the Kodiak Mirror, a newspaper of general
circulation, published in the Kodiak Island Borough, for three (3)
consecutive weekly publications, which notice shall state the
current total bond indebtedness, including authorized but unsold
bonds of the Borough, the cost of the debt service on the current
indebtedness; and the total assessed valuation within the Borough;
(B) Copies of the notice shall be posed in each
polling place designated in Section Four of this Resolution and
in addition thereto, copies of the notice shall be posted at the
front door of the U.S. Post Office, at Kodiak, and at the City
Hall at Kodiak, and at the front door of the Main School at
Kodiak, and all such notices shall be posted more than twenty (20)
days prior to the date of said election and the first publication
of said notice shall be more than twenty (20) days prior to the
date of said election.
Section 6: The notice of the bond election shall
be signed by the Clerk of the Kodiak Island Borough and shall be
substantially in the following form:
NOTICE OF BOND ELECTION
At the regular election to be held in the Kodiak
Island Borough on Tuesday, the 3rd day of November, 1970, the
following Propositions will be submitted to the qualified voters
of the Kodiak Island Borough:
PROPOSITION NO. 1:
Shall the Kodiak Island Borough, State of Alaska,
incur an indebtedness in a sum not exceeding FIVE MILLION SIX
HUNDRED AND EIGHTY THOUSAND and

on all rents and on all services made within the confines of

to be used for and applied towards the retirement of any

The boundaries of all precincts are as defined in
the Alaska Administrative Code 6AAC59 Section 336 through 345 and
in the Ordinances and Resolutions of the Kodiak Island Borough,
and in the Emergency Regulations of the Secretary of State.
The total bonded indebtedness, including authorized
but unsold bonds of teh Kodiak Island Borough as of this date is
FOUR MILLION SEVEN HUNDRED EIGHTEEN THOUSAND TWENTY -SEVEN and
No /100ths ($4,718,027.00) DOLLARS.
The cost of the debt service on the current
indebtedness is NINETY -NINE THOUSAND NINETY -ONE and 75 /100ths
($99,091.75) DOLLARS.
The total assessed valuation within the Kodiak Island 1
Borough is FIFTY -FIVE MILLION FIVE HUNDRED SEVEN THOUSAND TWO
HUNDRED THIRTY -SEVEN and No /100ths ($55,507,237.00) DOLLARS.
If a majority or more of the qualified voters voting
at said election vote in favor of Proposition No. 1 herein as
above set forth, the Borough Assembly of the Kodiak Island Borough
pursuant to the provisions of Section 07.15.030 and Section
07.30.010, will issue general obligation bonds for the purposes
set forth in the Proposition approved by the voters and
said general obligation bonds will be in the amount of
Proposition No. 1 approved by the voters and in series and
denominations as may be required, secured by a pledge of the
full faith and credit of the Kodiak Island Borough and the
Borough Assembly will take such further action as may be
necessary.
If a majority or more of the qualified voters
voting at said election vote in favor of Proposition No. 2, the
Borough Assembly may enact the tax as a levy upon buyers with
imposition upon sellers of the obligation of collecting it at
the time of sale or at the time of collection with respect to
credit transactions and transmitting it to the Kodiak tAI50

Section 8: Absentee Voting: Persons entitled to
vote: Any qualified voter within the Borough who expects to be
absent from his election precinct on the day of the election, or
who will be unable to vote in said Borough election precinct, by
reason of physical disability on the day which any special or
general election is held, or if he believes he will be unable to
be present at the polls because of physical inaccessibility of
the polling place causing undue travel expense, hardship or
hazard, may cast a ballot in said Borough election upon complying
with these provisions for casting an absentee ballot.
Application for Ballots: Time requisite; not more
than twenty (20) nor less than five (5) days for filing by mail,
and not more than twenty (20) days nor less than one (1) day
where filing in person, prior to the Borough election, any voter,
being properly qualified, who expects to be absent from his
election precinct, or unable to vote therein on the day of
election, may file either in person or by mail, his written
application to the Borough Clerk for an absentee voter's ballot.
The application shall be signed by the applicant, show his place
of residence, and shall make clear to the Clerk of the Borough
the applicant's right to a ballot. The absentee voter must
appear before any Notary Public or Officer in the District, City,
County, Borough, Territory or other Federal District, or in any
State, Territory or District within the United States or District
of Columbia, or before two (2) attesting witnesses, both of
whom shall be qualified voters of the Borough.
Section 9: The judges and clerks of said election
to be hereafter appointed by Resolution of the Borough Assembly
shall canvass the votes cast at said election on the Propositions
above stated and shall prepare and file their returns of said
election with the Borough Assembly, stating in words and figures
the number of votes cast for and against the proposals voted upon,

be not less than a majority of the votes cast on that Proposition,
certify that the Proposition carried and if otherwise, then that
the Proposition failed and if the votes cast in the affirmative
on said Proposition No. 2 be not less than a majority of the votes
cast on that Proposition, certify that that Proposition carried
and if otherwise, then that that Proposition failed.
Section 10: If Proposition No. 1 is certified
by the election officials as having received the required majority
of qualified votes for approval, and having been thereby
regularly carried, then said Borough Assembly of the Kodiak Island
Borough upon canvass of the returns made, in their discretion,
may authorize the issuance of general obligation bonds in the
amount approved by the voters at said election, plus interest,
payable semi - annually and maturing within twenty -five (25) years
or less, the proceeds of which shall be used by the Borough
Assembly of the Kodiak Island Borough for the purposes described
in Section 1 as part of Proposition No. 1 above which has been
approved by the voters and shall be issued in such series and
denominations as the Borough Assembly may deem necessary from time
to time.
And if Proposition No. 2 is certified by the election
officials as having received the required majority of qualified
votes for approval, and having been thereby regularly carried,
then the said Borough Assembly of the Kodiak Island Borough
upon canvass of the return made, in their discretion, may enact
the tax as a levy upon buyers with imposition upon sellers of
the obligation of collecting it at the time of sale or at the
time of collection with respect to credit transactions and
transmitting it to the Kodiak Island Borough, the revenues derived
therefrom to be used for the retirement of bonded indebtedness

approved by the voters in Proposition No. 1 and incurred in
connection with the construction of new schools in the Kodiak
Island Borough School District.

WHEREAS, the Kodiak Island Borough has large amounts of money
invested in survey costs of property currently retained in Kodiak
Island Borough ownership, and;
WHEREAS, properties retained in Borough ownership generate no
tax monies for the operation of the Kodiak Island Borough, and;
WHEREAS, much interest has been expressed by the general public
for the sale of properties retained by the Kodiak Island Borough, and;
WHEREAS, the offering for sale of Kodiak Island Borough owned
properties would be in the best interest of the general public.
NOW, THEREFORE, BE IT RESOLVED by the Kodiak Island Borough
Assembly that the following described real properties be sold at public
auction, under conditions set forth in the Land Management Agreement
between the Kodiak Island Borough and the State of Alaska, Department of
Natural Resources, Division of Lands:
PORT LIONS SUBDIVISION, 1ST ADDITION: Lots 10, 11, 12, 13, 14,
15, 16, 17, Block 13, and Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13,
14, 15, Block 16, and Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, Block 18,
all lots being zoned Residential.
