1970-02 Approving The Final Plat Marinovich Subdivision.r KODIAK ISLAND BOROUGH ASSEMBLY RESOLUTION NUMBER 70 -2 -R WHEREAS, Section 6 of Sub- Chapter 4 of Chapter 5 of the Kodiak Island Borough Code of Ordinances and Resolutions re- quires that a final plat shall be approved by the Borough Assem- bly by resolution and WHEREAS, Section 9 of Sub- Chapter 4 of Chapter 5 of the Kodiak Island Borough Code of Ordinances and Resolutions pro- vides that the Borough Assembly after report by the Planning and Zoning Commission may vary or modify the requirements of the sub- division regulations ordinance so that a subdivider may develop his property in a reasonable manner so long as the public welfare and the interest of the Borough is protected, and WHEREAS, It has been brought to the attention of the Kodiak Island Borough Assembly that Peter J. Marinkovich and Philomena Marinkovich were formerly the owners of a portion of real property situated in the Kodiak Recording Precinct, Third Judicial District, State of Alaska, described as follows: Tract B of a partial subdivision of U.S. Survey No. 3218, the plat of Tract B having been approved by the Kodiak School District platting board on May 16, 1961, and thereafter the said Peter J. and Philomena Marinkovich having re- subdivided Tract B into Tracts B -1 and B -2 on July 7, 1961, as appears by a plat prepared by Hugh B. Tyler, Registered Surveyor dated May 22, 1962 and WHEREAS, the said J. and Philomena Marinkovich having mortgaged Tract B -1 and thereafter having sold the same but having retained possession of Tract B -2 and the plat of the sub- division of Tract B not having been approved by the Kodiak School District platting board and in view of the change of ownership it appearing to the Kodiak Island Borough Assembly that strict ad- herence to the requirements of Sub - Chapter 4, Chapter 5, Kodiak Page One, RESOLUTION NO. 70 -2 -R • Island Borough Code of Ordinances and Resolutions would result in difficulty, substantial hardship and injustice to the partie concerned and the Kodiak Island Borough being fully advised in the premises, and WHEREAS, said property has now been resurveyed by G.S. BEST, Registered Land Surveyor and a new plat submitted, dated November 26, 1969 and entitled "Resubdivision of Tract B, U.S. Survey No. 3218. Now, therefore, BE IT RESOLVED, that the plat plan of the Resubdivision of Tract B, U.S. Survey No. 3218 dated Nov- ember 26, 1969, signed by G.S. BEST, Registered Land Surveyor, be and the same is hereby accepted as a final plat and that the Kodiak Island Borough Assembly accept all streets, alleys, ease- ments and other open spaces dedicated to public purposes as pro- vided for in said plat.
