Introduced: 11/07/96 Public Hearing: 11/26/96 Adopted: 11/26/96 AN ORDINANCE REZONING A 115.12 ACRE PARCEL LOCATED WITHIN SECTIONS 20 AND 21, T3OS R32W (KARLUK WATERSHED) FROM C- CONSERVATION ZO W- WATERSHED (GENERALLY LOCATED SOUTH OF THE VILLAGE OF KARLUK) WHEREAS, the Planning and Zoning Commission held a public hearing on this rezoning; and WHEREAS, this rezone will serve to both define and protect the Karluk watershed, creating a buffer area around Karluk's water supply that can also be used for recreation and subsistence by residents; and WHEREAS, the Planning and Zoning Commission has recommended that the Kodiak Island Borough Assembly approve this rezoning; and WHEREAS, the Planning and Zoning Commission has adopted findings of fact in support of this recommendation. NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: This ordinance is not of general application and shall not be codified. Section 2: The 115.12 acre parcel, as defined by the Karluk watershed area metes and bounds description dated October 2, 1996, within Sections 20 and 21, T3OS R32W, is hereby rezoned from C- Conservation to W- Watershed. Section 3: The findings of fact of the Kodiak Island Borough Planning and Zoning Commission in recommending the approval of this rezone are hereby confirmed as follows: 17.72.020 A. Findings as to the Need and Justification fora Change or Amendment. A rezone from R1- Single- family Residential to W- Watershed is needed and justified because the W- Watershed zoning district permits development that: Kodiak Island Borough, Alaska Ordinance No. 96 -18 Page 1 of 2 A. will protect and regulate the Karluk water supply to ensure maintenance of adequate water supply and good water quality; and B. will prohibit all other land uses not compatible with the maintenance of the community watershed. 1732.020 B. Findings as to the Effect a Change nr Amendment would have on the Ohjective.s of the Comprehensive Plan. A change of zoning from C- Conservation to the W- Watershed zoning district is necessary to provide basic protection of water quality for the Karluk community. This rezone is in conformity with specific objectives and recommendations stated in both the 1968 Kodiak Island Borough Comprehensive Plan and the 1984 Karluk Comprehensive Plan.
