1996-15 Rezoning U.S. Survey 2261 Trident Basin Float Plan FacilityKODIAK ISLAND BOROUGH ORDINANCE NO. 96 -15 Introduced by: Mayor Selby Requested by: Planning and Zoning Commission Drafted by: Community Development Department Introduced: 10/03/96 Public Hearing: 10/17/96 Adopted: 10/17/96 AN ORDINANCE REZONING APPROXIMATELY 11.5 ACRES WITHIN U.S. SURVEY 2261, (TRIDENT BASIN FLOAT PLANE FACILITY) FROM C- CONSERVATION TO LI -LIGHT INDUSTRIAL WHEREAS, this parcel was granted a conditional use permit by the Kodiak Island Borough Planning and Zoning Commission in March of 1995 permitting a float plane facility and associated structures to be located in the C- Conservation zoning district; and WHEREAS, the Planning and Zoning Commission identified a rezone to LI -Light Industrial as a logical progression for this parcel; and WHEREAS, the Planning and Zoning Commission held a public hearing on this rezoning and recommends that the Kodiak Island Borough Assembly approve this rezoning; and WHEREAS, the Planning and Zoning Commission has adopted findings of fact in support of this recommendation. NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: This ordinance is not of general application and shall not be codified. Section 2: This 11.5 acre portion of U.S. Survey 2261, consisting of the area encompassed by the approved conditional use permit for the Trident Basin Float Plane Facility and further identified by meets and bounds description, is hereby rezoned from C- Conservation to LI -Light Industrial. Section 3: The findings of fact of the Kodiak Island Borough Planning and Zoning Commission in recommending the approval of this rezone are hereby confirmed as follows: Kodiak Island Borough, Alaska Ordinance No. 96 -15 Page 1 of 2 17 72 020 A. Findings as to the NAM and Justification fnr a Change or Amendment. A rezone from C- Conservation to LI -Light Industrial is needed and justified because the LI -Light Industrial zoning district permits development that: A. is consistent with current and proposed development trends in the area; B. is suitable for this site, given the physical characteristics and location of the tract; C. will not create any nonconforming land uses; D. is consistent with the Near Island Comprehensive Plan. 17.72.020 B. Findings as to the Fffect a Change or Amendment would have on the Ohjectives of the Comprehensive Plan_ A rezone of the area identified as and granted a CUP for a float plane facility in Trident Basis is consistent with the intent and objectives of the Near Island Comprehensive Plan. In the section described as "Description of Development Categories and Allowable Land Use, the Near Island Comprehensive Development Plan (1987) identifies a possible float plane facility to "...include docking and tie -down areas, a shore -based haul out area for maintenance, and parking areas (p. 14). The maps accompanying that plan specifically designate Trident Basin as the site for a proposed floatplane facility and aerodrome. This intent dovetails with long- standing Port of Kodiak harbor plans to eliminate the extremely dangerous situation of boats and float plane traffic sharing the crowded St. Paul's Harbor Channel.
