1995-06 Rezoning Tideland Survey 1504KODIAK ISLAND BOROUGH ORDINANCE NO. 95 -06 Introduced by: Mayor Selby Requested by: Planning and Zoning Commission Drafted by:Community Development Department Introduced: 11/02/95 Public Hearing: 11/21/95 Adopted: 11/21/95 AN ORDINANCE REZONING PROPOSED TRACT A, B, AND C, ALASKA TIDELANDS SURVEY 1504, FROM C- CONSERVATION TO NU- NATURAL USE (GENERALLY LOCATED IN ANTON LARSEN BAY, ADJACENT TO THE STATE HIGHWAY, INCLUDING THE BOAT LAUNCH RAMP AND DOCK) WHEREAS, the Kodiak Island Borough resource management office has suggested that certain state of Alaska property surrounding the boat launch ramp and dock at Anton Larsen Bay be rezoned from C- Conservation to NU- Natural Use; and WHEREAS, a subdivision request creating Tracts A, B, and C, Alaska Tidelands Survey 1504, has been granted preliminary approval by the Planning and Zoning Commission; and WHEREAS, the creation of these tracts, their rezone, and their lease to the Kodiak Island Borough and the Alaska Department of Fish & Game will provide access to the public for recreational and subsistence uses and a vital transportation Zink between the Kodiak road system and several outlying communities and settlements; and WHEREAS, the NU- Natural Use zoning district allows public coastal docking facilities as a permitted use; and WHEREAS, the Kodiak Island Borough Planning and Zoning Commission held a public hearing on this rezoning; and WHEREAS, the Kodiak Island Borough Planning and Zoning Commission has recommended that the Kodiak Island Borough Assembly approve this rezone. NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: This ordinance is not of general application and shall not be codified. Section 2: The 6.6 acres of land, proposed as Tracts A, B, and C, Alaska Tidelands Survey 1504, surrounding the boat launch ramp and dock at Anton Larsen Bay is hereby rezoned from C- Conservation to NU- Natural Use Section 3: The findings of the Kodiak Island Borough Planning and Zoning Commission in recommending approval of this rezone are hereby confirmed as follows: Kodiak Island Borough, Alaska Ordinance No. 95 -06 Page 1 of 2 17 72 090 A Findings as to the Need and Justification for a Changer Amendment A rezone of property identified as newly platted Tideland Traces A, B, and C of Alaska Tidelands Survey 1504 on Anton Larsen Bay from C -- Conservation to NU- Natural Use Lands is needed and justified because the NU- Natural Use Lands zoning district: A. allows public coastal docking facilities as a permitted principal use; B. is consistent with the historical use of this site, will provide enhanced public access for the human use of fish and wildlife resources as indicated by KIBC 17.12.010 (Description and Intent, NU- Natural Use District). C. will provide for a greater measure of protection of the recreational resources and natural amenities of this area which is principally used for a range of recreational activities including boating, camping, fishing, hunting, sightseeing, and beachcombing; and D. will not create any nonconforming land uses. 17 77 020 B Findings as to the Fffert a Change or Amendment would have on the Ohjertives of the Comprehensive Plan A change of zoning from C -- Conservation to the NU- Natural Use Lands zoning district is consistent with the historical use of this property and provides public access for the human use of fish and wildlife and other recreational resources consistent with both the description and intent of the NU- Natural Use Zoning District and the Kodiak Island Borough Coastal Management Plan.
