1993-50 Placing the Question of Extending the Womens Bay Service Area on the October 5, 1993 Ballot.WHEREAS, WHEREAS, Kodiak Island Borough, Alaska Introduced by: Requested by: Drafted by: Introduced: Public Hearing: Amended: Adopted: Assembly Womens Bay Service District Borough Clerk 07/01/93 07/15/93 07/15/93 07/15/93 KODIAK ISLAND BOROUGH ORDINANCE NO. 93 -50 AN ORDINANCE PLACING THE QUESTION OF EXTENDING THE WOMENS BAY SERVICE AREA ON THE OCTOBER 5, 1993 BALLOT the Womens Bay Service Area for road services and fire protection was established in 1975 by Ordinance No. 75 -26 -0; and a portion of the old military road which continues from the end of Sargent Creek Road toward Jack Lake provides the only practical access to three houses which are within the service area boundary and whose owners are paying taxes for road services and fire protection; and WHEREAS, pursuant to Contract No. 93 -11, the parties to the contract urge the Kodiak Island Borough Assembly to place the question of annexation of the area on the next general election ballot; and WHEREAS, Kodiak Island Borough Code 4.05.040 provides that the assembly shall initiate any action to alter a service area by introducing an ordinance effecting the proposed action; and WHEREAS, Kodiak Island Borough Code 4.05.060 provides that an ordinance altering a service area shall not be effective unless approved by a majority of the qualified voters voting on the question in each area affected by the ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: The Womens Bay Service Area will be altered by addition of the following described area: "A parcel of land located adjacent to the Bells Flats Alaska Subdivision, Plat 69 -04, filed in the Kodiak Recording District, Third Judicial District, State of Alaska, and more particularly described as follows: Ordinance No. 93 -50 Page 1 of 3 Beginning at Triangulation Station "Hill C Alternate ", which bears S 79° 40'51" W, 8,685.558 feet from U.S.C. & G. S. Triangulation Station '. "Crab "; thence N 13° 02'32" E, a distance of 200.49 feet to Triangulation Station "Hill D Alternate "; THE TRUE POINT OF BEGINNING. thence from the TRUE POINT OF BEGINNING due West, a distance of 870.567 feet; thence due North, a distance of 536.396 feet; thence N 55 a distance of 1,186.356 feet; to a point common with the most Northwest corner of the Bells Flats Alaska Subdivision; thence following the westerly boundary of the Bells Flats Alaska Subdivision along a line bearing S 04° 44'22 "W, a distance of 1,225.18 feet, to the TRUE POINT OF BEGINNING. CONTAINING 18.142 ACRES MORE OR LESS." Section 2: An election shall be held on Tuesday, October 5, 1993, between the hours of 7:00 a.m. and 8:00 p.m. of said date and there shall be submitted to the duly qualified registered voters of the Womens Bay Service Area the following question: Shall the boundary of the Womens Bay Service Area be altered by the addition of the following described area? "A parcel of land located adjacent to the Bells Flats Alaska Subdivision, Plat 69 -04, filed in the Kodiak Recording District, Third Judicial District, State of Alaska, and more particularly described as follows: Beginning at Triangulation Station "Hill C Alternate ", which bears S 79 40'51 "W, 8,685.558 feet from U.S.C. i G. CONTAINING 18.142 ACRES MORE OR LESS" KODIAK ISLAND BOROUGH Section 3: A person who is qualified to vote in the Womens Bay Service Area or the area described in this ordinance may vote in the election. Section 4: The polling place for this election will be in the Bells Flats precinct at the Womens Bay Fire Hall. Section 5: Notice of the election shall be published not less than thirty days prior to the election in the form and manner provided by AS 29.38.050 and Title 7 of the Kodiak Island Borough Code of Ordinances. Section 6: Upon passage of the proposition to alter the boundary of the Womens Bay Service Area by the qualified voters of that area and upon certification of said election, this ordinance shall become effective.
