AN ORDINANCE REZONING A PORTION OF U.S. SURVEY 2735, MIDDLE BAY,
FROM B-- BUSINESS TQ RR1- -RURAL RESIDENTIAL ONE

the Kodiak Island Borough Planning and Zoning Commission held an
advertised public hearing on a proposal to rezone a portion of U.S.
Survey 2735 from B-- Business 14 RR1- -Rural Residential One; and
the Kodiak Island Borough Planning and Zoning Commission has
recommended that the Kodiak Island Borough Assembly approve the
above referenced rezone.
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMELY OF THE KODIAK ISLAND
BOROUGH THAT:

Section 1: This ordinance is not of general application and shall not be codified.
Section 2: A 1.15 acre parcel of land located in U.S. Survey 2735, and further
described as:
Kodiak Island Borough, Alaska
A tract of land situated in U. S. Survey No. 2735, beginning at
Corner Number One (1), which bears N 84 °39'W, a distance of
968 feet from Corner No. Three (3) of U. S. Survey No. 2735;
thence N 05 °21' E, a distance of 250 feet to Corner No. Two;
thence S 84 °39' E, a distance of 200 feet to Corner No. Three;
thence S 05 °21' W, a distance of 250 feet to Corner No. Four;
thence N 89 °39' W, a distance of 200 feet to the Place of
Beginning, located in the Kodiak Recording District, Third Judicial

Section 3: The findings of the Planning and Zoning Commission in recommending
the approval of this rezone are hereby confirmed.
1. Findings as to the Need and Justification for the Rezone.
A rezone from B -- Business to RR1- -Rural Residential One is needed and
justified because the RR1- -Rural Residential One Zoning District permits
development that:
A. is consistent with other residential developments in the surrounding
area;
B. will not create any nonconforming land uses when the applicant
completes the conversion of the one existing structure to residential use;
C. will reduce the potential traffic that could be generated on the
Chiniak Road;
2. Findings as to the Effect the Rezone would have on the Objectives
of the Comorehensive Plan.
A change of zoning from B-- Business So RR1- -Rural Residential One on
a portion of U.S. Survey 2735 is not addressed in the 1968 Kodiak
Island Borough Comprehensive Plan. This request was evaluated under
the enforceable policies of the Kodiak Island Borough Coastal
Management Program and found to be "not applicable" for the most
part.
Section 4: The official zoning map shall be updated to reflect this rezoning.
