AN ORDINANCE REZONING A 52.5 ACRE PARCEL OF LAND LOCATED ON THE
KARLUK RIVER FROM C CONSERVATION TO RD- -RURAL DEVELOPMENT
(GENERALLY LOCATED ON THE KARLUK RIVER)
WHEREAS, the Kodiak Island Borough Planning and Zoning Commission held an
advertised public hearing on a proposal to rezone a 52.5 acre parcel of
land located along the Karluk River from C -- Conservation to RD- -Rural
Development; and
WHEREAS, the Kodiak Island Borough Planning and Zoning Commission has
recommended that the Kodiak Island Borough Assembly approve the
above referenced rezone.
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
Section 1: This ordinance is not of general application and shall not be codified.
Section 2: A parcel of land located along the Karluk River and described as follows:
SW1 /4, SW1 /4, SE1 /4, SE1 /4
S1/2, SE1 /4, SW1 /4, SE1 /4
Located within Section 30; and,
W1/2, W1/2, NE1 /4, NE1 /4
E1/2, NW1 /4, NE1 /4
S1/2, SW1 /4, NW1 /4, NE1 /4
N1/2, NW1 /4, SW1 /4, NE1 /4
SE1 /4, SE1 /4, NE1 /4. NW1 /4
NE1 /4, NE1 /4, SE1 /4, NW1 /4
Located within Section 31, all within T305, R30W, Seward
Meridian, comprising 52.5 acres (more or less),
is hereby rezoned from C -- Conservation to RD- -Rural Development.

Section 3: The findings of the Planning and Zoning Commission in recommending
the approval of this rezone are hereby confirmed.
1. Findings as to the Need and Justification for the Rezone.
A rezone from C -- Conservation to RD- -Rural Development is needed and
justified because the RD- -Rural Development Zoning District permits
development that:
A. is consistent with the type of development that private land owners
increasingly want to develop in remote areas of the Borough;
B. will not increase the nonconformity of any existing uses or
structures;
C. must be setback from marine and anadromous waters unless the use
developed is water- dependent;
D. will result in a sensible and efficient use of coastal lands; and
E. allows for a balance of uses, due to the range of uses permitted,
which will not favor short run gains at the expense of long -term benefits.
2. Findings as to the Effect the Rezone would have on the Objectives
of the Comorehensive Plan.
A change of zoning from C -- Conservation to RD- -Rural Development of
52.5 acres of land located along the Karluk River is generally consistent
with the applicable policies of the Kodiak Island Borough Coastal
Management Program. This tract is located in the area designated for
Development with Restrictions. A conditional use permit is required prior
to development of intensive commercial land uses. This will allow the
placement of stipulations on future permit requests or approvals subject
to Planning and Zoning Commission review. This will ensure consistency
with the policies of the Kodiak Island Borough Coastal Management
Program.
Section 4: The official zoning map shall be updated to reflect this rezoning.
