1993-22 Rezoning U.S. Survey 50 From C-Conservation To RD-Rural Development. (Generally Located in Snug Harbor Along the West Shore of Moser Bay.)WHEREAS, the Kodiak Island Borough Planning and Zoning Commission held an advertised public hearing on a proposal to rezone U.S. Survey 50 from C-- Conservation IQ RD- -Rural Development; and WHEREAS, the Kodiak Island Borough Planning and Zoning Commission has recommended that the Kodiak Island Borough Assembly approve the above referenced rezone. NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: This ordinance is not of general application and shall not be codified. Section 2: Section 3: KODIAK ISLAND BOROUGH ORDINANCE NO. 93 -22 Introduced by: Mayor Selby Requested by: Planning & Zoning Commission Drafted by: Community Development Department Introduced: 04/01/93 Public Hearing: 04/15/93 Adopted: 04/15/93 AN ORDINANCE REZONING U.S. SURVEY 50 FROM C-- CONSERVATION JQ RD- -RURAL DEVELOPMENT U.S. Survey 50 is hereby rezoned from C -- Conservation to RD- -Rural Development. The findings of the Planning and Zoning Commission in recommending the approval of this rezone are hereby confirmed. 1. Findings as to the Need and Justification for the Rezone. A rezone of U.S. Survey 50 from C -- Conservation to RD- -Rural Development is needed and justified because the RD- -Rural Development Zoning District permits development that: A. is consistent with the type of development that people tend to develop in upland areas of the Kodiak Island Borough; B. will not increase the nonconformity of any nonconforming uses or structures; and Kodiak Island Borough, Alaska Ordinance No. 93 -22 Page 1 of 2 C. is generally consistent with the provisions of the Kodiak Island Borough Coastal Management Plan. 2. Findinas as to the Effect the Rezone would have on the Obiectives of the Comprehensive Plan. A change of zoning from C -- Conservation to RD- -Rural Development on U.S. Survey 50, a 29.10 acre tract located in Snug Harbor along the west shore of Moser Bay, is generally consistent with the applicable policies of the KIB Coastal Management Plan. This tract is located in the area designated for Development with Restrictions. The stream crossing the lot is located in the Conservation district of the KIB Coastal Management Plan and can only be developed with approval from the Alaska Department of Fish and Game. A conditional use permit is required prior to development of a large scale lodge operation. This will allow the placement of stipulations on future permit requests or approvals subject to Planning and Zoning Commission review. This will insure consistency with the policies of the KIB Coastal Management Plan. Section 4: The official zoning map shall be updated to reflect this rezoning.
