AN ORDINANCE REPEALING KODIAK ISLAND BOROUGH CODE 17.72.080
BOUNDARY CHANGE -- PROTEST AND RELATED PROVISIONS OF THE
KODIAK ISLAND BOROUGH CODE DUE TO INCONSISTENCY WITH
ALASKA STATUTES 29.20.160(d)
WHEREAS, it has been determined that Kodiak Island Borough Code 17.72.080 is
inconsistent with Alaska Statutes 29.20.160(d); and
WHEREAS, the Planning and Zoning Commission has recommended that Kodiak
Island Borough Code 17.72.080 and related references be repealed due
to inconsistencies with Alaska Statutes 29.20.160(d);
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
Section 1: This ordinance is of a general and permanent nature and shall become a
part of the Kodiak Island Borough Code of Ordinances.
Section 2: Kodiak Island Borough Code 17.72.080 is hereby repealed.
Section 3: Kodiak Island Borough Code 17.72.055 is hereby amended as follows:

17.72.055 Submission to assembly. A. Within thirty days after the
planning commission has acted favorably upon a proposed zoning change
in accordance with the above provisions, a report with recommendations
shall be submitted to the assembly together with the proposed
ordinance. Such recommendations of the planning commission shall be
advisory only and shall not be binding upon the assembly. When an
ordinance has been forwarded to the borough assembly, the assembly
shall act in accordance with this chapter and notice shall be issued as
provided in section 17.72.070 by the borough clerk. [Notiee- ef—tho
