(Located in Amook Bay.)KODIAK ISLAND BOROUGH ORDINANCE NO. 93 -16 Introduced by: Mayor Selby Requested by: Planning & Zoning Commission Drafted by: Community Development Department Introduced: 03/04/93 Public Hearing: 03/18/93 Adopted: 03/18/93 A ORDINANCE REZONING A TEN ACRE PARCEL OF LAND KNOWN AS T31S R28W TL2004 FROM C-- CONSERVATION TO RD -RURAL DEVELOPMENT (LOCATED IN AMOOK BAY) WHEREAS, the Kodiak Island Borough Planning and Zoning Commission held an advertised public hearing on a proposal to rezone a ten acre parcel of land located in Amook Bay from C -- Conservation to RD -Rural Development; and WHEREAS, the Kodiak Island Borough Planning and Zoning Commission has recommended that the Kodiak Island Borough Assembly approve the above referenced rezone; NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: This ordinance is not of general application and shall not be codified. Section 2: T31S R28W TI2004, consisting of ten (10) acres and generally located in Amook Bay of Kodiak Island, is hereby rezoned from C -- Conservation to RD- -Rural Development. Section 3: The findings of the Planning and Zoning Commission in recommending the approval of this rezone are hereby confirmed. 1. Findings as to the Need and Justification for the Rezone. A change of zoning, of a ten acre tract located in Amook Bay, from C -- Conservation to HD- -Rural Development is needed and justified because the RD- -Rural Development Zoning District permits development that: A. - is consistent with the type of development that tends to be developed in upland areas of remote Kodiak Island; Kodiak Island Borough, Alaska Ordinance No. 93 -16 Page 1 of 2 C. is generally consistent with the provisions of the Kodiak Island Borough Coastal Management Plan. B. will not create any nonconforming uses or structures; and A change of zoning from C -- Conservation to RD- -Rural Development on a ten (10) acre tract located in Amook Bay is generally consistent with the applicable policies of the Kodiak Island Borough Coastal Management Plan. This tract is located in the area designated for Development with Restrictions. A conditional use permit is required prior to development of intensive commercial land uses. This will allow the placement of stipulations on future permit requests or approvals subject to Planning and Zoning Commission review. This will ensure consistency with the policies of the Kodiak Island Borough Coastal Management Plan. Section 4: The official zoning map shall be updated to reflect this rezoning.
