1993-06 Rezoning U.S. Survey 1578 to RD SW Shore of Olga BayWHEREAS, WHEREAS, Section 1: Section 2: Section 3: KODIAK ISLAND BOROUGH ORDINANCE NO. 93 -06 Introduced by: Mayor Selby Requested by: Planning and Zoning Commission Drafted by: Community Development Department Introduced: 02/11/93 Public Hearing: 03/04/93 Adopted: 03/04/93 AN ORDINANCE REZONING U.S. SURVEY 1578 FROM C--CONSERVATION RD- -RURAL DEVELOPMENT (LOCATED ALONG SOUTHWEST SHORE OF OLGA BAY) the Kodiak Island Borough Planning and Zoning Commission held an advertised public hearing on a proposal to rezone U.S. Survey 1578 from C-- Conservation Ig RD- -Rural Development; and the Kodiak Island Borough Planning and Zoning Commission recommended that the Kodiak Island Borough Assembly approve the above referenced rezone; NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: This ordinance is not of general application and shall not be codified. U.S. Survey 1578 is hereby rezoned from C-- Conservation t4 RD- -Rural Development. The findings of the Planning and Zoning Commission in recommending the approval of this rezone are hereby confirmed. 1. Findings as to the Need and Justification for the Rezone. A rezone of U.S. Survey 1578 from C-- Conservation RD- -Rural Development is needed and justified because the RD- -Rural Development Zoning District permits development that; -- . r ^•� ^• Zoning District t,crit l t n ucvcwNniCnt u ia �: A. is consistent with the type of development that tends to be developed in upland areas of remote Kodiak Island; Kodiak Island Borough, Alaska Ordinance No. 93-06 Page 1 of 2 Section 4: The official zoning map shall be updated to reflect this rezoning. ADOPTED BY THE KODIAK ISLAND BOROUGH ASSEMBLY THIS 4TH DAY OF MARCH, 1993 ATTEST: B. will not create any nonconforming uses or structures; and C. is generally consistent with the provisions of the Kodiak Island Borough Coastal Management Plan. 2. Findings as to the Effect the Rezone would have on the Objectives of the Comprehensive Plan. A change of zoning from C-- Conservation RD- -Rural Development on U.S. Survey 1578, a 5 acre tract located along the southwest shore of Olga Bay, is generally consistent with the applicable policies of the Kodiak Island Borough Coastal Management Plan. This tract is located in the area designated for development with restrictions. A conditional use permit is required prior to development of intensive commercial land uses. This will allow the placement of stipulations on future permit requests or approvals subject to Planning and Zoning Commission review.
