1993-04 Rezoning Lots 1-3 U.S. Mineral Survey 247 to RDKODIAK ISLAND BOROUGH ORDINANCE NO. 93 -04 Introduced by: Mayor Selby Requested by: Planning and Zoning Commission Drafted by: Community Development Department Introduced: 02/11/93 Public Hearing: 03/04/93 Adopted: 03/04/93 AN ORDINANCE REZONING LOTS 1, 2, AND 3, U.S. MINERAL SURVEY 247 FROM C-- CONSERVATION IQ RD- -RURAL DEVELOPMENT (LOCATED ALONG MOUTH OF AYAKULIK RIVER) WHEREAS, the Kodiak Island Borough Planning and Zoning Commission held an advertised public hearing on a proposal to rezone Lots 1, 2, and 3, U.S. Mineral Survey 247 from C -- Conservations RD- -Rural Development; and WHEREAS, the Kodiak Island Borough Planning and Zoning Commission recommended that the Kodiak Island Borough Assembly approve the above referenced rezone; NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: This ordinance is not of general application and shall not be codified. Section 2: Section 3: Lots 1, 2, and 3, U.S. Mineral Survey 247 is hereby rezoned from C--Conservation RD- -Rural Development. The findings of the Planning and Zoning Commission in recommending the approval of this rezone are hereby confirmed. 1. Findinas as to the Need and Justification for the Rezone. A rezone of Lots 1, 2, and 3, U.S. Mineral Survey 247 from C--Conservation RD- -Rural Development is needed and justified because the RD --Rural al D evelopme _ Z__ v.. a, a. a,oe the n✓--nural vCVCIVIJIIICIIt Zoning District permits development that: A. is consistent with the type of development that tends to be developed in upland areas of remote Kodiak Island; Kodiak Island Borough, Alaska Ordinance No. 93 -04 Page 1 of 2 ATTEST: B. will not create any nonconforming uses or structures; and C. is generally consistent with the provisions of the Kodiak Island Borough Coastal Management Plan. �. onyu -f-, Donna F. Smith, Borough Clerk Kodiak Island Borough, Alaska 2. Findings as to the Effect the Rezone would have on the Objectives of the Comprehensive Plan. A change of zoning from C -- Conservation to RD- -Rural Development on Lots 1, 2, and 3, U.S. Mineral Survey 247 three (3) tracts totalling 20 acres in overall area, which are located along the mouth of the Ayakulik River, is generally consistent with the applicable policies of the Kodiak Island Borough Coastal Management Plan. These tracts are located in the area designated for development with restrictions. A conditional -use permit is required prior to development of intensive commercial land uses. This will allow the placement of stipulations on future permit requests or approvals, subject to Planning and Zoning Commission review. This will ensure consistency with the policies of the Kodiak Island Borough Coastal Management Plan. Section 4: The official zoning map shall be updated to reflect this rezoning.
