1992-06 Amending Sections 13.01.070 and 13.01.150 Utilities of the Borough CodeWHEREAS, WHEREAS, KODIAK ISLAND BOROUGH ORDINANCE NO. 92 -06 Introduced by: Requested by: Drafted by: Introduced: Public Hearing: Adopted: Mayor Selby Service District No. 1 Engineering/ Facilities Director 03/05/92 03/19/92 03/19/92 AN ORDINANCE AMENDING SECTIONS 13.01.070 AND 13.01.150 UTILITIES OF THE BOROUGH CODE Service District No. 1 Advisory board has recommended that Chapter 13 Utilities of the Borough Code be amended; Service District No. 1 Advisory Board has recommended a procedure to provide for a vacant utility rate without physically turning the utilities off to the structure; and WHEREAS, Service District No. 1 Advisory Board has proposed reducing the monthly water service fee for service prior to the issuance of the certificate of occupancy. NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1. This ordinance is of a general and permanent nature and shall become a part of the Kodiak Island Borough Code of Ordinances. Section 2. Title 13 Utilities is amended as follows: 13.01.170 Vacancy. A. No reduction of charges will be made on partially vacant or vacant premises [fer erg s of Ie 1 unless the Kodiak Island borough finance director has first been notified of such intended vacancy. No allowance will be made for a Period of less than thirty (30) days. B. Service may be disconnected for periods of vacancy upon application to the borough [eashier] finance director and payment of disconnect and reconnect fees as established by [ 1 the current fee resolution. C. Service may be reduced on Partially vacant or vacant Premises anon application to the borough finance director and payment of administrative fees equivalent to disconnect and reconnect fees as established by resolution. When such vacancy or Partial vacancy occurs, the current rate for vacant premises, as set by resolution, will be charged the property owner. The Property owner will certify in Kodiak Island Borough, Alaska Ordinance No. 92 -06 Page 1 of 2 writing that the premises are vacant and will indicate the length of vacancy anticipated. The property owner of vacant or partially vacant premises will be reauired to recertify in writina that the premises remains in a vacant status when the duration of such vacancy exceeds 180 days from the oriainal certification or recertification. The property owner will notify the borough finance director immediately when the premises are aaain occupied. If the premises are aaain occupied and the finance director is not notified immediately. the account will be back - billed as if no vacancy occurred, 13.01.150 Charges -- Effective Date A [ Charges for water and /or sewer service shall commence when the premises is connected directly or indirectly to the systems or at the time of the deadline for connection established by the service, district or municipality, as the case may be, whichever occurs first. Water service charges . prior to the issuance of a certificate of occupancy. on a vacant premises will be levied at the current rate for a vacant premises as set by resolution. Water and sewer service charges shall be for the full month if connection is made before the fifteenth of the month and shall be deferred to the following month if connection is made after the fifteenth of the month. B. Upon the issuance of a building permit, charges for water and /or sewer service will be made at the current rate for a vacant premises, as set by resolution, Section 3: This ordinance shall become effective July 1, 1992.
