AN ORDINANCE RELATING TO THE APPOINTMEN OF
MEMBERS OF SERVICE AREA BOARDS OF SUPER SORS
WHEREAS, each year approximately ten service area bo
to be filled at the regular election; and
of supervisor seats are
WHEREAS, each year less than one -third of th seats are filled by declared
candidates; and
WHEREAS, the cost of hand counting the writs in candidates takes several hours of
time and several hundreds of do ".rs;
NOW, THEREFORE, BE IT ORDAINED BY HE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH:
Section 1. This ordinance is of a pt manent and general nature and shall become a
part of the Code of 0 dinances.
Section 2. KIBC 4.15.020 is ereby repealed and reenacted to read:

A. The gov- ning body of each borough service area shall be a service
area commission co isting of at least three, but not more than seven,
commissioners. The .ssembly shall establish the number of commissioners for each
service area at the t e the service area is proposed for formation, and if the assembly
fails to so act, the number of commissioners shall be three. The assembly may alter
the number of • • mmissioners constituting a given service area commission at any
time by ordin ce. The enactment of this section shall not affect the composition of
any boroug service area commission as it exists on the date of said enactment,
unless the omposition of said commission is subsequently altered in accordance with
the ter of this section.
B. The assembly shall appoint service area commissioners from a list
prep ed by the borough clerk of those who have expressed an interest in serving on
th commission. Each commissioner shall be a qualified voter residing in the service
ea.

Section 3. KIBC 4.15 is amended by adding a new section to read:
Section 5. KIBC 4.15.030 is repealed and reenacted to read:

4.15.025 Commission- -Oath of office. Before assuming office each
commissioner shall take an oath in writing to faithfully discharge the duties of his
office. The oath shall be filed with the borough clerk.
4.15.030 Commission -- Terms. A. Immediately aft : qualifying, the
commissioners first appointed after formation of a service area s :11 draw lots at the
office of the borough clerk to determine their initial terms of off e. Three classes of
commissioners shall be established by said drawing. In com -uting the membership
of said classes the total number of commissioners sh equal the number of
commissioners established in accordance with Section 4. 5.020.
The first class shall consist of commissio - rs equal in number to one -
third of the total number of commissioners, and the m bers of said class shall serve
an initial term of three years. The second class shal consist of commissioners equal
in number to one -third of the total number of com ' sioners, and the members of said
class shall serve an initial term of two years. he third class shall consist of the
remaining commissioners, and the members of :aid class shall serve an initial term of
one year. Thereafter, each commissioner s :11 serve a term of three years.
B. Enactment of the ordinanc- codified in this section shall not alter the
term of office of any service area com ssioner as said term exists on the date of
enactment. As each said term expires e successor to the commissioner whose term
has so expired shall be appointed for a term of three years.
