AN ORDINANCE ADOPTING THE 1991 UNIFORM PLUMBING CODE,
THE 1991 UNIFORM MECHANICAL CODE,
AND AMENDING KODIAK ISLAND BOROUGH CODE SECTION 15.12.
BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH:
Section 1. This ordinance is of a general and permanent nature and shall
become a part of the Code of Ordinances.
Section 2. Section 15.04.010, Adoption of building and other codes, is
hereby amended as follows:
15.04.010 Adoption of building and other codes. Except as provided elsewhere in
this title, the Uniform Building Code, 1988 Edition, published by the International
Conference of Building Officials; the 1999 [1987] National Electrical Code; the 1991
[1988] Uniform Plumbing Code; the 1991 [1988] Uniform Mechanical Code; the 1988
Uniform Code for the Abatement of Dangerous Buildings; the 1988 Uniform Housing
Code; the 1988 Fire and Life Safety Code; the 1988 Uniform Fire Code; and the 1986
CABO One and Two Family Dwelling Code are adopted by reference as the building
codes for the Kodiak Island Borough. They are adopted to regulate erection,
construction, enlargement, alteration, repair, moving, removal, conversion, demolition,
occupancy, equipment, use, height, area, and maintenance of buildings or structures in
the Kodiak Island Borough; to provide for the issuance of permits and collection of fees
therefor; and to provide penalties for violations of these regulations. The building codes
so adopted shall be interpreted, administered, and enforced with the borough building
official, who is authorized to take such action as may be reasonably necessary to enforce

the purposes of this section. The borough mayor may appoint or authorize an assistant
or agent to the building official if necessary to carry out the provisions of this title.
Section 3. Section 15.12 is amended by the addition of a new section
15.12.080 Code -- exception to read:
15.12.080 Code -- exception. Subsection 1003(k) of the Uniform Plumbing Code is
amended to read*
(k) Heat exchanger and other assemblies or methods of construction using
potable water shall be of listed construction and materials. Potable water shall be
separated from the fluids or gasses by a minimum of two separate walls, with a positive,
vented leak detection path. The sections in contact with potable water shall be of
material and weights suitable for potable water as set forth in this chapter.
EXCEPTION: Heat exchanger may be of a single wall construction
provided that (1) the heat transfer medium is water or other practically
nontoxic fluid having a toxicity rating or class of 1, as listed in Clinical
Toxicology of Commercial Products, 5th Edition; (2) the pressure of the heat
transfer medium is limited to a maximum of thirty (30) psig by an approved
safety or relief valve; and (3) the heat exchanger is prominently and
permanently labeled with instructions concerning items (1) and (2) above.
