CONDUCTED BY LICENSED OPER TORS

BE IT ORDAINED by the Kodiak Island Borough Assembly that:
Section 1. This ordinance is of a per anent and general nature
and shall become a part of the Code of Ordina es.
Section 2. Title 9 is amended by =dding a new chapter, 9.30,
Gambling, to read:
9.30.010 Gamin • o•erators •rohlb ed. No gambling or gaming activities
otherwise permitted under AS 05.15 m y be conducted within the Kodiak
• Island Borough unless specifically a horized under a permit Issued pursuant
to AS 05.15.100 (a) or (b) and co •ucted directly by the permittee. No
"operator," as that term is defin in AS 05.15.210(24), may conduct any
gambling or gaming activites on •ehalf of a permitee.
9.30.020 Individual in ar•e. A. No gambling or gaming activity
otherwise authorized under AS 05.15 shall be considered to be conducted
directly by the permittee nless the permittee has designated an individual
who Is present and actu ly in charge of the gambling or gaming activity at
all times during which t is conducted or open to be conducted. The
individual in charge - all be a bona fide officer of the permittee, a member of
its governing body or an individual who is a bona fide and active member of
the permittee org- ization.
B. The p mittee may designate an alternate individual to conduct the
authorized activities during the absence of the individual in charge so long as
the alternate eets the same qualifications as the individual In charge. In no
event, how- er, may the individual in charge and an alternate be
simultaneously in charge of otherwise authorized gambling or gaming activities
conducted in two different locations.
C. The permittee shall designate and identify the individuaI in .,:h-
and the alternate, if any, to the Borough Clerk prior to condtti
gambling or gaming activity and the Borough Clerk shall issue an
identification card to the designated individual. The indivii'uaI in charge or
the alternate must have the identification card in his or hir immediate
possession whenever conducting authorized gambling or gaming activities.
The Borough Clerk may establish reasonable expiration or renewal dates for
identification cards and may develop application forms for the same but there
shall be no charge for issuance of an identification , ard.
9.30.030 Forfeiture. If used in violation o this chapter, the following
property shall be subject to seizure and forfeiture:
(a) a gambling device or gambling reco as defined in As 11.66.280;
and
(b) money used as a bet or stake in an activity prohibited by this
chapter.
