1989-15 Establishing an Emergency Fund to Accumulate Costs of the Oil Spill Disaster and Appropriating $500,000 in Oil Spill Cleanup Grant Funds Received From the State of AlaskaAN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY ESTABLISHING AN EMERGENCY FUND TO ACCUMULATE COSTS OF THE OIL SPILL DISASTER AND APPROPRIATING OIL SPILL CLEANUP GRANT FUNDS RECEIVED FROM THE STATE OF ALASKA AND EXXON SHIPPING COMPANY WHEREAS, on March 24, 1989, the Exxon tanker Valdez went aground in the Prince William Sound spilling over 10 million gallons of oil into the Gulf of Alaska, and WHEREAS, this oil spill has the potential of being disastrous to the Kodiak environment, and WHEREAS, the Alaska Department of Environmental Conservation has awarded the Kodiak Island Borough a grant of $500,000 to be used for oil spill cleanup efforts, and WHEREAS, it was critical that these funds be immediately available for expenditure due to the imminent arrival of the spilled oil in the Kodiak area, and WHEREAS, en emergency ordinance establishing the Oil Spill Disaster Fund and appropriating funds received from the State of Alaska and Exxon Shipping Company was adopted by the Assembly on April 6, 1989, and WHEREAS, expenditures of these funds could go beyond the 60 days allowed by the emergency ordinance: NOW, THEREFORE, BE IT ORDAINED by the Kodiak Island Borough Assembly that: Section 1. This ordinance is of an emergency nature and shall not be codified. Section 2. The Kodiak Island Borough hereby accepts the $500,000 oil spill cleanup grant from the Alaska Department of Environmental Conservation. Section 3. Staff is hereby authorized and directed to establish an Oil Spill Disaster Fund. This fund will be utilized to account for all expenses incurred and all revenues received in this regard. Section 4. The FY 88/89 budget is hereby amended by recognizing additional revenue to the General Fund from state grants in the amount of $500,000, and by appropriating $500,000 from the General Fund to the Oil Spill Disaster Fund. The Mayor is authorized to expend funds from the Oil Spill Disaster Fund for the purpose of protecting waters and shorelines within and immediately adjacent to the Kodiak Island Borough, from the detrimental effects of this oil spill. These funds shall be expended only for the purposes and in the manner described in the contract executed April 6, 1989, between the Kodiak Island Borough and the Department of Environmental Conservation.
