1988-07 Defining the Effective Dates of Ordinances, Resolutions, and Other Acts of the AssemblyAN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY DEFINING THE
EFFECTIVE DATES OF ORDINANCES, RESOLUTIONS, AND OTHER ACTIONS
OF THE ASSEMBLY
WHEREAS, from time to time there is confusion about the
actual time an action of the assembly takes effect; and
WHEREAS, the Code of the Kodiak Island Borough currently does
j not address this;
NOW, THEREFORE, BE IT ORDAINED by the Kodiak Island Borough
(Assembly that:
Section 1. This ordinance is of a general and permanent
nature and shall become a part of the Code of Ordinances.
Section 2. A new section, 1.04.040, is hereby added to read:
1.04.040 Effective dates of ordinances, resolutions and other
actions of the assembly - -Time. An ordinance, resolution or other action
takes effect at midnight on the day of adoption unless the ordinance,
resolution or other action provides that it shall take effect at a
!specified time, in which case the ordinance, resolution or other action
'takes effect at the time specified. If the ordinance, resolution, or
,other action specifies that it shall become effective on a given day, but
I does not specify a time, the ordinance, resolution or other action shall
become effective at midnight on the day specified.
