ORDINANCE NO. 85 -27 -0
AN ORDINANCE CHANGING THE BOUNDARY OF FIRE PROTECTION DISTRICT
NO. ONE AND PROVIDING FOR AN ELECTION TO EFFECT THE BOUNDARY CHANGE.
WHEREAS, Fire Protection District No. One was created by Ordinance
No. 68 -23 -0, and the residents within Fire Protection District No. One elected
to exercise road powers at a special election held on January 14, 1969; and
WHEREAS, the Veterans of Foreign Wars building, the Kodiak Island
Sportsman's Association indoor shooting range, and Timberline sawmill are
located outside Fire Protection District No. One, thus having no fire protec-
tion service', and these improvements represent substantial investments for
which fire protection is desirable; and
WHEREAS, Section 4.05.040 requires that the Assembly initiate any
action to alter a service area by introducing an ordinance; and
WHEREAS, Section 4.05.060 provides that an ordinance altering a
service area shall not be effective unless approved by a majority of the
qualified voters voting on the question in each area affected by the
ordinance.

NOW, THEREFORE BE IT ORDAINED by the Kodiak Island Borough Assembly
Section 1: The area known as Fire Protection District No. One is
altered by the addition of the following described area:
All of that portion of land lying within Sections 19, 20,
29, and 30, Township 27 South, Range 19 West, Seward
Meridian, Alaska, platted as City of Kodiak Sanitary
Landfill Site Survey, Plat No. 69 -10; survey of state land
creating Tract "A Plat No. 70 -1; Sawmill Subdivision,
Lots 1 and 2, Plat No. 84 -46.
Containing 319.13 acres, more or less.
Section 2: An election shall be held on Tuesday, October 1, 1985,
between the hours of 7:00 a.m. and 8:00 p.m. of said date and there shall be
submitted to the duly qualified residents and voters of Fire Protection
District No. One and the additional area described previously the following
question:
"Shall the boundary of Fire Protection District No. One be
altered by the addition of the following described area:
All of that portion of land lying within Sections 19, 20,
29, and 30, Township 27 South, Range 19 West, Seward
Meridian, Alaska, platted as City of Kodiak Sanitary
Landfill Site Survey, Plat No. 69 -10; survey of state land
Section 3: A person who is qualified to vote in Alaska and the
i Kodiak Island Borough and who is a resident of Fire Protection District
No. One or the area described in this ordinance may vote in the election.
Section 4: The polling place for this election will be the East
I Elementary School, Mission Road Precinct.

thirty days prior to the election in the form and manner provided by AS
29.38.050 and Title 2 of the Kodiak Island Borough Code of Ordinance and
Resolutions.
Section 6: Upon passage of the proposition to alter the boundary of
Fire Protection District No. One by the qualified voters of that area, and
upon certification of said election, this ordinance shall become effective.
