1985-26 Amending Title 2 Administration and PersonnelKODIAK ISLAND BOROUGH ORDINANCE NO. 85 -26 -0 AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY AMENDING THE KODIAK ISLAND BOROUGH CODE IN TITLE 2 ADMINISTRATION AND PERSONNEL. WHEREAS, the Kodiak Island Borough Code Title 2 has not been kept current with job description changes, and WHEREAS, chapters have been added in numerical sequence based upon the date of the ordinance instead of a basis of organization, and WHEREAS, changes to bring the code current and more orderly are desirable. NOW, THEREFORE, BE IT ORDAINED by the Kodiak Island Borough Assembly that Title 2 of the Kodiak Island Borough Code be amended as follows: Section 1: Chapter numbers and titles shall be reorganized to read: Title 2 Administration and Personnel Chapters: 2.04 Elections 2.08 Bonding of Officers and Employees 2.10 Appointment of Officers, Commissions and Committees 2.12 Personnel 2.16 Borough Assembly 2.20 Borough Mayor 2.21 Borough Clerk 2.22 Borough Engineer 2.23 Resource Management Officer 2.30 Finance Department 2.31 Assessing Department (section number change only) 2.32 Community Development Department (section number change only) 2.33 Data Processing Department 2.34 Facilities Department 2.35 Fire Department 2.40 Planning Commission (section number change only) 2.41 Emergency Services (section number change only) 2.42 Kodiak Economic Development Commission (section number change only) 2.43 Parks and Recreation Committee (section number change only) Section 2: Chapters within Title 2 shall be amended to read: 2.21.030 Deputy clerk. The deputy borough clerk shall assume the powers and duties of the borough clerk only in the absence of the borough clerk from office, or by written direction from the borough clerk to exercise particular powers and duties, or when the assembly determines by resolution that the borough clerk is unable to perform the duties of the office. 2.21.040 Duties. The deputy borough clerk shall perform other functions and duties related to the legislative process under the super- _ vision and direction of the borough clerk. Section: Chapter 2.22 BOROUGH ENGINEER 2.22.010 Appointment and duties. 2.22.010 Appointment and duties. The mayor shall appoint a borough engineer who shall administer the borough subdivision regulations, maintain engineering records and documents, administer design and inspection of all horizontal construction, provide administration and operation for water and solid waste disposal, administer local service roads and trails program, and perform other duties as prescribed by the mayor and by resolution of the assembly. Sections: 2.23.010 Resource management officer. The resource management officer shall be responsible for planning and supervising the selection, acquision,.management and disposal of Kodiak Island Borough real property and resources. 2.23.020 Duties. The resource management officer shall administer the selection, acquisition, and exchange of land programs; the disposal of Borough surplus lands and resources, including the assessment for the demand of land; coordinates land management activities for survey, appraisal, and zoning; acquires easements and right -of -ways for roads, sewer, water lines, and other municipal operated utilities; participates in land planning, economic development, resource management programs, and coastal zone management decisions; holds public meetings; collects data relating to Borough land and.its resource values; assists in the preparation of the department budget and formulation of departmental policies and procedures; interfaces with other governmental agencies on land programs, supervises resource specialists or technicians; provides a full range of planning and management activities; provides a full range of land and resource disposal actions; and provides land acquisition actions. Sections: 2.30.010 Director. 2.30.020 Accounting. 2.30.030 Internal audit. 2.30.040 Treasury. Chapter 2.33 RESOURCE MANAGEMENT OFFICE 2.23.010 Resource management officer. 2.23.020 Duties. Chapter 2.30 FINANCE DEPARTMENT 2.30.010 Director. The finance department shall be headed by the director of finance who shall be ex officio borough treasurer, borough accountant and internal auditor. The finance director is appointed by the mayor. 2.30.020 Accounting. The accounting and fiscal reporting functions of the borough shall be under the supervision of the director of finance. The director of finance shall maintain custody of and responsibility for all fiscal records of the borough not specifically entrusted to other offices by the director of finance. 2.30.030 Internal audit. The director of finance, ex officio internal auditor, shall work closely with the external auditors in the best interest of the borough. All departments will make available such documents and records as are necessary to accomplish this function. 2.30.040 Treasury. The treasury functions shall be headed by the director of finance, ex officio borough treasurer, who will have custody of all public moneys and investment securities of the borough. The director of finance, ex officio borough treasurer, will also administer the propert tax collections and fiscal operations function and act as paying agent for outstanding bonds and interest coupons. Sections: 2.33.010 Data processing manager. There is created a borough data processing department headed by the data processing manager. The manager is appointed by the borough mayor. 2.33.020 Duties. The data processing manager shall be responsible for directing the operations of the data processing department of the borough. The data processing department shall provide centralized and decentralized data processing to all borough departments. The data processing manager will also provide data processing services to other entities as may be legally directed by the borough mayor. 2.33.030 Security officer. Data processing manager shall be the security officer on all borough data processing equipment and systems including any equipment and systems that interface or network with any borough equipment and /or systems. Sections: Sections: Chapter 2.33 DATA PROCESSING DEPARTMENT 2.33.010 Data processing manager. 2.33.020 Duties. 2.33.030 Security officer. Chapter 2.34 FACILITIES DEPARTMENT 2.32.010 Facility coordinator. 2.32.020 Building official. 2.32.010 Facility coordinator. The mayor shall appoint a facility coordinator who shall maintain records, administer design and inspection of vertical construction, coordinate supervision and inspection of village construction, administer grants at local and village levels and perform other duties as prescribed by the mayor or by resolution of the assembly. 2.32.020 Building official. The mayor shall appoint a building official to perform inspections, enforce the provisions of the building codes, issue permits, and maintain accurate records under the general supervision of the facilities coordinator. Chapter 2.35 FIRE DEPARTMENT 2.35.010 Fire chief. 2.35.020 Drills and instruction. 2.35.030 Arson suppression. 2.35.040 Notice to abate fire hazard. 2.35.050 Equipment. 2.35.060 Fire protection agreements with nearby communities. 2.35.070 Equipment use outside borough. 2.35.080 Vehicles. 2.35.090 False alarms. 2.35.010 Fire chief. The department shall consist of a chief and other personnel as the chief and borough mayor may deem necessary for the effective operation of the department. The chief shall be appointed by the borough mayor with the recommendation of the fire district advisory board for an indefinite period of time, and the chief's tenure of office shall depend upon good conduct and efficiency. The chief shall be technically qualified by training and experience and have ability to command persons and hold their respect and confidence. The chief shall be removed only for just cause and in accordance with borough personnel regulations. 2.35.020 Drills and instruction. The chief shall conduct suitable drills or instruction in the operation and handling of equipment, first aid and rescue work, salvage, study of buildings in the borough, fire prevention, water supplies, and all other matters generally considered essential to good firemanship and safety of life and property from fire. 2.35.030 Arson suppression. The chief is required to assist the proper authorities in suppressing the crime of arson by investigating or causing to be investigated the cause, origin, and circumstances of all fires. 2.35.040 Notice to abate fire hazard. Any person with a notice to abate any fire hazard or hazards shall comply therewith and promptly notify the chief. 2.35.050 Equipment. The department shall be equipped with such apparatus and other equipment as may be required from time to time to main- tain its efficiency and properly protect life and property from fire. No fire apparatus or equipment shall be used or any article be taken away or concealed without proper authority. Apparatus and equipment purchases shall be made after approval of the borough mayor. 2.35.060 Fire protection agreements with nearby communities. The borough is authorized to enter into agreements or contracts with nearby incorporated communities or governing bodies of other organizations to provide the members of such community organizations with fire protection or to establish a mutual aid system. 2.35.070 Equipment use outside borough. No apparatus shall be hired out or permitted to leave the borough, except in response to a call for aid at a fire in a neighboring community, without the consent of the chief. The chief shall have power to assign equipment for response to calls for outside aid in accordance with section 2.35.060, and in other cases only when the absence of such equipment will not jeopardize protection in this fire district area. 2.35.080 Vehicles. A. All fire department motor equipment and all personal cars of department members showing a flashing blue light shall have right -of -way over all other traffic when responding to an alarm. B. Each member of the department driving a vehicle shall be issued a suitable insignia to be attached to the vehicle. C. No person shall drive any vehicle over fire hose except upon specific orders from the chief or other personnel in charge where the hose is used. D. No person shall park any vehicle or otherwise cause any obstruction to be placed within twenty -five feet of the entrance to any fire station or other place where fire apparatus is stored, or within ten feet of any fire hydrant or cistern. E. No unauthorized person with any vehicle shall follow within five hundred feet of any apparatus belonging to the department, nor park any vehicle within three hundred feet of a fire. 2.35.090 False alarms. No person shall maliciously turn in or cause to be turned in a false alarm. Section 3: This ordinance shall become effective upon certification of the October 1, 1985 election.
