1985-25 Changing SA1 BoundariesKODIAK ISLAND BOROUGH ORDINANCE NO. 85 -25 -0 AN ORDINANCE CHANGING THE BOUNDARY OF SERVICE DISTRICT NO. 1 AND PROVIDING FOR AN ELECTION TO EFFECT THE BOUNDARY CHANGE. WHEREAS, Service District No. 1 of the Mill Bay - Monashka Service H Area was created by Ordinance No. 78 -6 -0, and the residents within Service District No. 1 elected to exercise sewer, water, and road powers at a special election held on April 18, 1978; and WHEREAS, Service District No. 1 Sewer and Water Improvements Project No. 82 -2 constructed public sewer and water facilities which are readily available to the owners of Lot 4, Block 6 and Lots 21 through 23, Block 7, Monashka Bay Alaska Subdivision; and WHEREAS, construction plans have been prepared for Service District No. 1 Sewer and Water Improvements Project No. 85 -1 which could provide public sewer and water facilities to the portion of Miller Point Alaska Subdivision which is not now included in Service District No. 1; and WHEREAS, in the interest of public health it is desirable to extend public utilities to serve the portion of Miller Point Alaska Subdivision which is not now included in Service District No. 1, Lot 4, Block 6 and Lots 21 through 23, Block 7, Monashka Bay Alaska Subdivision; and WHEREAS, Section 4.05.040 requires that the Assembly initiate any action to alter a service area by introducing an ordinance; and WHEREAS, Section 4.05.060 provides that an ordinance altering a service area shall not be effective unless approved by a majority of the qualified voters voting on the question in each area affected by the ordinance. Section 1: The area known as Service District No. 1 of the Mill Bay - Monashka Service Area is altered by the addition of the following described area, and any subdivisions thereof: Lot 4, Block 6, Monashka Bay Alaska Subdivision, Plat No. 68 -8; Lots 21 through 23, Block 7, Monashka Bay Alaska Subdivision, Plat No. 68 -8; Lots 1 through 6, Block 1, Miller Point Alaska Subdivision, Plat No. 67 -3; Lots 1 through 3, Block 2, Miller Point Alaska Subdivision, Plat No. 67 -3; Abercrombie Drive (Miller Point Road), Miller Point Alaska Subdivision, Plat No. 67 -3; Except the State of Alaska highway right -of -way lying within Miller Point Alaska Subdivision, Plat No. 67 -3. that: NOW, THEREFORE BE IT ORDAINED by the Kodiak Island Borough Assembly Containing 30.87 acres, more or less. "Miller Point Alaska Subdivision, the following question: "Shall the boundary of Service District No. 1 be altered by the addition of the following described area: Lot 4, Block 6, Monashka Bay Alaska Subdivision, Plat No. 68 -8; Lots 21 through 23, Block 7, Monashka Bay Alaska Subdivision, Plat No. 68 -8; Lots 1 through 6, Block 1, Miller Point Alaska Subdivision, Plat No. 67 -3; Lots 1 through 3, Block 2, Miller Point Alaska Subdivision, Plat No. 67 -3; Abercrombie Drive (Miller Point Road), Miller Point Alaska Subdivision, Plat No. 67 -3; Except the State of Alaska highway right -of -way lying within Miller Point Alaska Subdivision, Plat No. 67 -3. Section 2: An election shall be held on Tuesday, October 1, 1985, between the hours of 7:00 a.m. and 8:00 p.m. of said date and there shall be submitted to the duly qualified residents and voters of Service District No. 1, Lot 4, Block 6 and Lots 21 through 23, Block 7, Monashka Bay Alaska Subdivision; and Lots 1 through 6, Block 1 and Lots 1 through 3, Block 2, // YES /_/ NO Section 3: A person who is qualified to vote in Alaska and the Kodiak Island Borough and who is a resident of Service District No. 1 or the area described in this ordinance may vote in the election. Section 4: The polling place for this election will be the East Elementary School, Mission Road Precinct. Section 5: Notice of the election shall be published not less than thirty days prior to the election in the form and manner provided by AS 29.38.050 and Title 2 of the Kodiak Island Borough Code of Ordinance and Resolutions. Section 6: Upon passage of the proposition to alter the boundary of Service District No. 1 by the qualified voters of that area, and upon certification of said election, this ordinance shall become effective.
