1985-24 Changing MBSA BoundariesAN ORDINANCE CHANGING THE BOUNDARY OF THE MONASHKA BAY ROAD SERVICE
AREA AND PROVIDING FOR AN ELECTION TO EFFECT THE BOUNDARY CHANGE.
WHEREAS, the Monashka Bay Road Service Area was created by Ordinance
No. 82 -42 -0, and the residents within the Monashka Bay Road Service Area
elected to exercise road powers at a special election held on January 11,
1983; and
WHEREAS, sections of Sawmill Circle and Lakeview Drive were
completed in 1984, and Monashka Circle and Bay View Drive are scheduled for
completion it 1986; and
WHEREAS, the grants which provided funding for constructing those
roads require that maintenance be done by the local municipality; and
WHEREAS, Section 4.05.040 requires that the Assembly initiate any
action to alter a service area by introducing an ordinance; and
WHEREAS, Section 4.05.060 provides that an ordinance altering a
service area shall not be effective unless approved by a majority of the
qualified voters voting on the question in each area affected by the
ordinance.

NOW, THEREFORE BE IT ORDAINED by the Kodiak Island Borough Assembly
Section 1: The area known as Monashka Bay Road Service Area is
altered by the addition of the following described area:
All of that portion of land lying within Sections 20 and
21, Township 27 South, Range 19 West, Seward Meridian,
Alaska, platted as Monashka Bay Alaska Subdivision, and
recorded in the Kodiak Recording District on September 9,
1968, Plat No. 68 -8; Except the State of Alaska highway
right -of -way lying within Monashka Bay Alaska Subdivision,
and Lot 4, Block 6 and Lots 21 though 23, Block 7,
Monashka Bay Alaska Subdivision.
Containing 280.79 acres, more or less.
Section 2: An election shall be held on Tuesday, October 1, 1985,
between the hours of 7:00 a.m. and 8:00 p.m. of said date and there shall be
submitted to the duly qualified residents and voters of Monashka Bay Road
Service Area and Monashka Bay Alaska Subdivision, except Lot 4, Block 6, and
'Lots 21 through 23, Block 7, Monashka Bay Alaska Subdivision, the following
question:
"Shall the boundary of the Monashka Bay Road Service Area
be altered by the addition of the following described
area:
All of that portion of land lying within Sections 20 and
21, Township 27 South, Range 19 West, Seward Meridian,
Alaska, platted as Monashka Bay Alaska Subdivision, and
recorded in the Kodiak Recording District on September 9,
1968, Plat No. 68 -8; except the State of Alaska highway
right -of -way lying within Monashka Bay Alaska Subdivision,
and Lot 4, Block 6 and Lots 21 through 23, Block 7,
Monashka Bay Alaska Subdivision."

Section 3: A person who is qualified to vote in Alaska and the
Kodiak Island Borough and who is a resident of the Monashka Bay Road Service
Area or the area described in this ordinance may vote in the election.
Section 4: The polling place for this election will be the East
Elementary School, Mission Road Precinct.
Section 5: Notice of the election shall be published not less than
thirty days prior to the election in the form and manner provided by AS
29.38.050 and Title 2 of the Kodiak Island Borough Code of Ordinance and
Resolutions.
Section 6: Upon passage of the proposition to alter the boundary of
the Monashka Bay Road Service Area by the qualified voters of that area, and
upon certification of said election, this ordinance shall become effective.
