1985-21 Pertaining to UtilitiesSection 1: Chapter 13.01 is amended by the addition of the following i sections: Section 13.01.155 Charges- -Late Payment Fees. Bills not paid by the ! 15th day of the month (or first workday thereafter) shall be subject to a late payment fee. This fee shall be calculated at one percent (1%) per month of the outstanding balance, or a minimum fee to be $3.00 per month for each month or portion thereof past due, whichever is greater. UTILITIES. KODIAK ISLAND BOROUGH ORDINANCE NO. 85 -21 -0 AN ORDINANCE REVISING CERTAIN SECTIONS OF TITLE 13 PERTAINING TO Section 13.01.055 Location of Individual Private Utility Connections. No individual service line may cross private property other than the lot which the utility connection serves. Section 2: The following sections of Chapter 13.01 are amended: Section 13.01.080 Connection - -Cost Computation. A. When an application has been made to the borough cashier for water and /or sewer service connection, the same will be installed as soon as practicable by the borough. The work to be done by the borough shall be all work between the main and the property line, and all material and labor used in making such connection shall be charged on a "cost plus percentage" basis, as determined by resolution of the borough assembly to cover costs. (Ord. 82- 3- O(part), 1982). B. Charges for turning on (or turning off) existing services shall be a flat fee of $30.00 or actual cost, whichever is greater. C. Charges for utility service installation inspection shall be a flat fee of $30.00, plus $20.00 for each additional trip to the site beyond the initial inspection. Section 13.01.100 Several Properties Served by One Connection. A. Where water and /or sewer service exist at the time of enactment of the ordinance codified in this title for the use of several properties or families from one connection, the party owning the connection will be held responsible for all charges as though he were the owner of the properties benefited by the connection. The terms of this section do not abrogate the provisions of Section 13.01.030 as improvements are made to the system. 1sB. Where one property has more than one service, such as, but not limited to, mobile home parks and apartment houses, the property owner shall receive the billing for all units. esl. Upon presentation of satisfactory evidence by the owner, or his agent, to the borough cashier that senior citizens actually reside on the property, the account will be adjusted to charge senior citizen rates for those dwelling units which would normally qualify under the provisions of Section 13.01.140. bs2. The owner, or his agent, shall immediately notify the borough cashier when a senior citizen vacates the property. es3. Water and /or sewer service shall be deemed to be provided end-water aedfer- sewer- ekarges- she**- beeeme- effective with regard to premises connected directly or indirectly to the system on the date of such connection. (Ord. 82- 3- 0(part), 1982). A. Water service charges shall be prorated from the date of connection. B. Sewer service charges shall be for the full month if connection is made before the fifteenth of the month and shall be deferred to the following month is connection is made after the fifteenth of the month. Section 13.01.170 Vacancy. A. No reduction of charges will be made on partially vacant or vacant premises. B. Service may be disconnected for periods of vacancy of not less than six months upon application to the borough cashier and payment of disconnect and reconnect fees as established by Section 13.01.0808. (Ord. 82- 3- 0(part), 1982). Section 3: The following sections of Chapter 13.02 are amended: Section 13.02.060 Delinquency and Penalty. C. A deposit equal to the estimated costs of disconnecting and reinstating the service has been paid, with total cost to be determined as set forth in Section 13.01.080B. Any excess deposit will be refunded, and any balance due will be billed on the next monthly billing. (Ord. 82- 3- 0(part), 1982). Section 13.02.090 Water Shortages -- Penalties. A. Extreme Water Shortage - -Water Waste -- Penalty. Any person, firm, of corporation wasting water, or using more than his or its allotted water during an extreme water shortage, shall be subject to a civil penalty of one dollar per gallon used over the allotted quota. B. Critical Water Shortage - -Water Waste -- Penalty. Any person, firm, or corporation wasting water, or using more than his or its allotted quota during a critical water shortage, shall be subject to a civil penalty of ten dollars per one hundred gallons of water used over his or its allotted quota.
