1985-05 Amending Personnel Manual - Resignations1 1 7 KODIAK ISLAND BOROUGH ORDINANCE 85 -5 -0 AN PERSONNEL POLICIES AND KODIAK AS ASSEMBLY RESIIGNATIONS WHEREAS, by a vote of the electorate on 2 October 1984 and as ratified by the Assembly of the Kodiak Island Borough by Resolution 84- 111 -R, the form of government of Kodiak.Island Borough is to be changed rom a Manager - Assembly to a strong Mayor - Assembly government, and Lb WHEREAS, it is often the normal protocol for a oming mayor to ask for the formal resignation in writing of all departm n heads which he will either accept or reject upon taking office, and 4 WHEREAS, at this time few, if any, of the d •artment heads hold contracts that afford protection from being oust positions without adequate notice that allows i, employment, and WHEREAS, the new form of govern i41 i Kodiak Island Borough could leave them -wen through no fault of their own. To be valid, the resignation must include reason for leaving Borough service. Failure to comply with these requirements shall result in the ) r ). 1 1 7 r cancellation of any normal separation benefits and may become cause for rejection of rehire at a future time. 1001.1 RESIGNATIONS (Protocol) Upon a change of the encumbent in the office of Mayor, under normal protocol, the mayor may elect to ask for the resignations of all department heads upon taking office. If the mayor so elects to exercise this right of office, he (she) will accept or rejeg't these resignations in a reasonable time period, not to exceed t o weeks after taking office. Termination of employment shall • one month after date of acceptance. Department heads whose re- ignations are accepted shall be compensated as outlined in Secti•n 1004.1. 1004 DISMISSAL NOTICE AND SEVERANCE PAY - Employees -subjeet to force - reduction layoff o• dismissed without prejudice shall be given ten (10) days' not ce and severance pay not to exceed ten (10) days. Appeal Procedure - See Chapter 11, Gri ance Procedure. 1004.1 SEVERANCE PAY DEPARTMENT HEADS Any department head whose resignat on is accepted by the incoming mayor by the change in the encu •ent of that office, and not throw cause, shall be entitled to r neration of two months' salary. This severance pay shall be in addition to accrued leave or other benefits due and payable pon separation.
