1984-71 Amending Chapter 17.03, General Provisions and Use Regulation, of the Borough Code1 r) , 1 1 KODIAK ISLAND BOROUGH ORDINANCE NO. 84 -71 -0 AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY AMENDING CHAPTER 17.03, GENERAL PROVISIONS AND USE REGULATION, OF THE BOROUGH CODE. The Kodiak Island Borough Hereby Ordains: Section 1: That Section 17.03.060, Building Permits, is hereby amended: 17.03.060 Buildfeg- Perefte Zoning Compliance. A bei4d4eg- permit Zoning compliance is required for the site grading (excavation and fill), erection, construction, establishment, moving, alteration, enlargement, repair, or conversion of any building or structure in any district established by this title, subject to the following: A. Grading (as defined in Chapter 70 of the Uniform; Building Code), exclusive of grading for a driveway access and /or a building site, in a residential or conservation district requires an exception from the Planning and Zoning Commission. For purposes of this title, driveway access means access from a public right -of -way to the building sitF, a maximum twenty -five (25) feet in width at the final grade of the driveway which does not create a cutbank of more than 10 feet. For purposes of this / title, a building site means that area required for the construction of any permitted structures in the district and a parking area. AT B. An application for a be4}d4eg- permit zoning compliance will be filed with the bei4d4eg- eff4e4e1 Community Development Department end on a form eppleved-by -hfed provided by the department. If the application meets the requirements of this title, as verified by the eeetag- e4f4eer department, and other applicable regulations, the a permit will be issued. $T C. In all cases where the planning commission or the board of adjust- ment has granted a variance or an exception to this title, the hut44fea efffe4ei department will issue e be4l44 - pere4t zoning compliance to allow the building work to be done in accordance with the decision, except that no permit will be issued following the granting of a variance or exception until the time for filing an appeal has expired and it is verified that no appeal has been filed. er D. No building permit shall' be issued by a building official until the ree4eg- ef44eer Community Development Department has verified from the application for a be41d4eg- permit zoning compliance for a proposed building that it conforms and will be occupied for a use in conformit with the provisions and regulations of this title, except that this provision shall not apply to building permits for residential structures when no yard or height changes are involved.
