1984-70 Amending Chapter 15.04, Building Codes, Pertaining to UBC Chapter 70it KODIAK ISLAND BOROUGH ORDINANCE 84 -70 -0 AN ORDINANCE OF THE KODIAK ISLAND BOROUGH AMENDING CHAPTER 15.04, BUILDING CODES, PERTAINING TO UBC CHAPTER 70. The Kodiak Island Borough Assembly Hereby Ordains: Section 1: That Section 15.04.055 of the Borough Code is created and amends Chapter 70 of the Uniform Building Code: 15.04.055 Uniform Building Code Chapter 70 amended. Section 7003. No person shall do any grading without first having obtained a grading permit from the building official except for the following: 1. Grading in an isolated, self- contained area if there is no danger apparent to private or public property. For the p ur p oses of this subsection, a lot located in a recorded subdivision shall not be considered an isolated, self - contained area. 2. An excavation below finished grade for basements and footings of a building, retaining wall or other structure authorized by a valid building permit. This shall not exempt any fill made with the material from such excavation nor exempt any excavation having an unsupported height greater than 5 10 feet after the completion of'such structure. 3. Cemetery graves. 4. Refuse disposal sites controlled by other regulations. 5. Excavations for wells or tunnels or utilities or driveways. 6. Mining, quarrying, excavating, processing, stockpiling of rock, sand, gravel, aggregate or clay where established and provided for by law, provided such operations do not affect the lateral support or increase the stresses in or pressure upon any adjacent or contiguous property. 7. Exploratory excavations under the direction of soil engineers, or engineering geologists. 8. An excavation which (a) is less than $ 5 feet in depth, or (b)I which does not create a cut slope greater than 5 10 feet inl height and steeper than one and one -half horizontal to one vertical. 9. Except as exempted in Section person shall do any grading without first obtaining zoning compliance, a grading permit, and a building permit for a structure or use allowed by the zoning code, from the building official. A separate permit shall be required for each site, and may cover both excavations and fills. Section 7006. (c) Plans and Specifications. When required by the building official each application for a grading permit shall be accompanied by two sets of plans and specifications. Section 7009. (b) Slope. Where the cut slope in rock exceeds thirty feet in height, a ten -foot wide bench shall be provided at twenty feet and at twenty -foot intervals thereafter. For slopes greater than one and one -half horizontal to one vertical, the adjacent property line shall be fenced except along public right -of -way before excavation is begun. Section 7010. (c) Preparation of Ground. The ground surface shall be prepared to receive fill by removing vegetation, noncomplying fill, topsoil and other unsuitable materials scarifying to provide a bond with the new fill, and, where slopes are steeper than f#ve two to one, and the height is greater than 5 feet, by benching into sound bedrock or other competent material as determined by the soils engineer. The bench under the toe of a fill on a slope steeper than f #ve two to one shall be at least 10 feet wide. The area beyond the toe of fill shall be sloped for sheet overflow or a paved drain shall be provided. Where fill is to be placed over a cut, the bench under the toe of fill shall be at least 10 feet wide but the cut must be made before, placing fill and approved by the soils engineer and engineering geologist as a suitable foundation for fill. Unsuitable soil is soil which, in the opinion of the building official or the civil engineer or the soils engineer or the *geologist, is not competent to support other soil or fill, to support structures or to satisfactorily perform the other functions for which the soil . is intended. i n 7 ) 1 1 1 5 'Z Section 7010. (f) Slope. The slope of fill surfaces shall be no steeper than is safe for the intended use. Fill surfaces shall be no steeper than two horizontal to one vertical for soils other than fractured rock and one and one -half horizontal to one vertical for fractured rock. i Section 7011. (b) Setbacks from Property Lines. The tops of cuts I, and toes of fill slopes shall be set back from the outer boundaries of the permit area, including slope -right areas and easements, in accordance with i 1i Figure No. 1 and Table No. 70 -C. In no case shall the setback be less than five feet when the fill slope is composed of fractured rock and no less than ' ! ten ATTEST: feet for cuts or fill slopes composed of soils other than rock. Section 7013. (a) Slopes. The faces of cut and fill slopes shall 1 be prepared and maintained to control against erosion. This control may 1 consist of effective planting. The protection for the slopes shall be installed as soon as practical and prior to calling for final approval. Where cut slopes are not subject to erosion due to the erosion- resistant character of the materials, such protection may be omitted. Any topsoil available from any cut area shall be stockpiled and used to recover the excavation site upon completion of grading and shall be seeded with appropriate grasses. Section 2: That Section 15.20.010B of the Borough Code is amended by deleting the word "tore" and replacing it with the word "ten" and adding the phrase "and meets all the requirements of Chapter 17.26 of the Borough Code."
