AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY AMENDING CHAPTER
8.12 OF THE KODIAK ISLAND BOROUGH CODE REQUIRING LITTERING PREVENTION MEASURES
'BY CONTRACTORS AND OTHER PERSONS HAULING MATERIALS.
WHEREAS, there have been numerous incidents of debris being scattered
Jon roads and highways in the Road Service District No. 1, the Bells Flats
Service District and the Monashka Bay Road Service District, and
it
l WHEREAS, there have been reports of broken windshields and headlights
!by citizens from rocks falling from trucks, and
WHEREAS, rock falling from trucks traveling at high rates of speed
have been seen near school bus stops with children present, and
II WHEREAS, the Kodiak Island Borough has adopted Health and Safety
powers.
NOW, THEREFORE, BE IT ORDAINED by the Kodiak Island Borough Assembly I
,;that Kodiak Island Borough Code Section 8.12.010 and Section 8.12.020 be
amended as follows:
8.12.010 Unlawful Acts. A. It is unlawful for any person to throw,
! drop, deposit, �scard or otherwise dispose of litter in or on any
not his own, or on any public property, building, park, recreation property
plot, street or highway, other than in lawful wastedisposalsiites area, parking;
! B. It is unlawful for an •erson to drive or move an vehicle on an
, hi•hwa or road unless the vehicle is so constructed and loaded as to prevent

material from falling or flowing from the vehicle and ittering the roa.way.
The only exceptions to this provision are the dropping of sand and
other material for the pur•ose of securin traction or water or other substance

8.12.020 Definition. As used in this chapter, "litter" means waste , ee
waste materials or materials of every kind and nature, including but not
(limited to rubbish, garbage, junk, paper, paper.products , rock, gravel, dirt
or other discarded objects.
