AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ESTABLISH G
SECTION 8.20 NON - AREAWIDE ALCOHOLIC BEVERAGE CONTROL.

WHEREAS, State Statute 4.16.010(d) all

WHEREAS, the Kodiak Island Borough at tt)'ir regular
election on October 2, 1984 placed the question /f whether or
h ot to acquire non - areawide powers to regulate alcoholic beverages
before the voters of the areas outside of th incorporated cities
of the Kodiak Island Borough, and
WHEREAS, the voters did vote to give the Kodiak Island
Borough the power to regulate alcoholic beverages,
NOW THEREFORE BE IT ORDAINED by the Kodiak Island
Borough Assembly that Section 8.20 of the Kodiak Island Borough
Code be amended by adding a new se ion to read as follows:

A. The powers adopted at this time shall be limited to
the power to restrict bar hours and days of operation.
8.20.020 Hours •.f sale and •resence on licensed •remises.
A. A person may not se , o er or sa e, g ve, urnish,
deliver or consu an alcoholic beverage on premises licensed
under Title 4 o the Alaska Statutes for the service and con-
sumption of alc•holic beverages between the hours of 2:00 AM
and 10:00 AM o Monday through Friday; and between the hours
of 2:30 AM an 10:00 AM on Saturday, Sunday, or any legal
holiday reco ized by the State of Alaska under AS 44.12.010.
B. A •erson may not sell, offer for sale, give, furnish,:
deliver or onsume, an alcoholic beverage on any other type
of premise licensed under Title 4 of the Alaska Statutes
between t e hours of 1:00 AM and 10:00 AM Monday through Fri-
day, and 1:30 AM to 10:00 AM on Saturday, Sunday, or on any
legal h• iday recognized by the State of Alaska under
AS 44. .010.
This ordinance is not applicable to deliveries of
alco •lic beverages by licensed wholesalers to licensed
prem ses.

D. A licensee, his agent or employee may not permit a
person to, and a person may not enter or remain on licensed
premises during the periods of time set forth in subsections
(A) and (B). This subsection does not apply to a licensee,
his agent, or employee who is on the premises to prepare for
the next day's business or to persons remaining on the pre-
mises of a restaurant or eating place licensed under Title 4
of the Alaska Statutes in order to consume food or non-
alcoholic beverages.
8.20.030 Definitions.
A. "Alcoholic beverage" includes but is not limited to,
whiskey, brandy, rum, gin, wine, ale, porter, beer and all
other spirituous, vinous, malt and other fermented or dis-
tilled liquors intended for human consumption and containing
more than one percent alcohol by volume.
B. "Licensed premises" means any or all designed por-
tions of a building or structure, rooms or enclosures in the
building or structure, or real estate leased, used, con-
trolled, or operated by a licensee in the conduct of busi-
ness for which he is licensed under Title 4 of the Alaska
Statutes.
C. "Licensee" means any person, corporation or other
entity which owns a license issued under Title 4 of the
Alaska Statutes.
