1984-38 Amending the Boundaries of the Mill Bay-Island Lake-Spruce Cape Service AreaAN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY AMENDING THE
BOUNDARIES OF THE MILL BAY - ISLAND LAKE- SPRUCE CAPE SERVICE AREA.
WHEREAS, Section 4.05.030 of the Kodiak Island Borough Code provides
for altering a service area by petition of at least 25% of the real property
owners within the boundaries proposed to be altered; and
WHEREAS, a petition was filed with the Kodiak Island Borough
Assembly on June 12, 1984 by residents adjacent to the existing boundaries of
the Mill Bay - Island Lake - Spruce Cape Service Area, requesting sewer and water
services; and
Section 4.05.030; and
WHEREAS, Section 4.05.040 of the Kodiak Island Borough Code provides
for the Assembly to alter a service area by introduction of an ordinance
effecting the proposed action; and
WHEREAS, Section 4.05.050 requires that the Assembly consider and
make the following findings:
1. That the services are needed in he area and that it is feasible for an
existing service district to provide these services. Public sewer and
water facilities will soon be available in the area, but the lots should
be included in the service district in order to provide access to the
services. The area to be included in the service district includes five
rural residential lots, of approximately 7.66 acres, with a population of
five households, a small percentage of the total area and population of
the existing service district;
2. That the total assessed value of the five lots proposed to be included in
the service d tract is $348,913;
3. That the fiv lots proposed to be included in the service district exhibit
similar ch,Lracteristics as the adjacent lots which are currently in the
service .istrict; and
That t e five lots proposed to be included in the service district have t
abi ty to pay for the proposed service as determined by the service
d -tract board.
WHEREAS, the petition filed does not meet all of the requirements of
KODIAK ISLAND BOROUGH

NOW, THEREFORE, BE IT ORDAINED by the Kodiak Island Borough Assembly
that:
Section 1: The service area know the Mill Bay - Island Lake - Spruce Cape Service
Area is hereby altered to include the following area:
Lots 20, 21, 22,and 23Sof B lock o7 and Lot 4 of Block 6
of Monashka Bay Alaska
Section 2: The following question shall be submitted to the voters at the
next regular election per Section 4.10.030 of the Kodiak Island Borough Code:

Subdivision.
Sect i on 3: This ordinance altering the boundaries of the Mill Bay - Island
Lake -Sruce Cape Service Area shall not be effective unless approved by a
majority of the qualified voters voting on the question in each area affected
