AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY GRANTING THE
CITY OF KODIAK POWER TO ADOPT AND ENFORCE REGULATIONS PROTECTING THE
MUNICIPAL WATERSHED AREA WHICH LIES OUTSIDE THE TERRITORIAL LIMITS OF THE
CITY.
WHEREAS, the City of Kodiak desires to regulate the use of City
watershed by controlling camping and other practices detrimental to the
water quality of the municipal system, and
WHEREAS, the majority of the municipal watershed lies outside the
territorial limits of the City of Kodiak, and
WHEREAS, under Alaska Statute 29.48.037(b), the Borough Assembly
may, by ordinance, grant the City of Kodiak the right to adopt and enforce
regulations for the protection of the municipal water system.
NOW, THEREFORE, BE IT ORDAINED, that under the authority of
Alaska Statute 29.48.037(b), the Kodiak Island Borough does hereby grant
to the City of Kodiak the power to adopt and enforce regulations protecting
that portion of the municipal supply and watershed that lies outside the
territorial limits of the City of Kodiak. These lands are generally
described as:
