Borough Clerk NOW, THEREFORE, BE IT for premises licensed to sell alcoholic ORDAINED by the Kodiak Island Borough Assembly Island Borough Code is amended by adding a new Chapter 8.20 8.20.010 Hours of sale and presence on licensed premises. 8.20.020 Definitions. 8.20.010 Hours of sale and presence on licensed premises. A. A person may not sell, offer for sale, give, furnish, deliver or consume an alcoholic beverage on premises licensed under Title 4 of the Alaska Statutes on (days) . A person may not sell, offer for sale, furnish, deliver or consume an alcoholic beverage on the licensed premises between the hours of 12 A.M. (midnight) and 10 A.M. each day except for Friday and Saturday when hours of closure shall be 1 A.M. to 10 A.M. B. A licensee, his agent, or employee may not permit a person to consume alcoholic beverages on the licensed premises between 12 A.M. and 10 A.M. each day except for Friday and Saturday when the hours of closure shall be from 1 A.M. to 10 A.M. C. A licensee, his agent, or employee may not permit a person to and a person may not enter licensed premises between the hours of 12 A.M. and 10 A.M. each day except for Friday and Saturday when the hours of closure shall be 1 A.M. to 10 A.M. This subsection does not apply to common carriers, as defined in Alaska Statute 42.10.420(2), or to an employee of the licensee who is on the premises to prepare for the next day's business or to persons remaining on the premises of a restaurant or eating place licensed under Title 4 of the Alaska Statutes to consume food or nonalcoholic beverages. 8.02.020 Definitions. In this chapter A. "alcoholic beverage" includes but is not limited to, whiskey, brandy, rum, gin, wine, ale, porter, beer and all other spirituous, vinous, malt and other fermented or distilled liquors intended for human consumption and containing more than one percent alcohol by volume. B. "licensed premises" means any or all designed portions of a build- ing or structure, rooms or enclosures in the building or structure, or real estate leased, used, controlled, or operated by a licensee in the conduct of business for which he is licensed under Title 4 of the Alaska Statutes. C. "licensee" means any person, corporation or other entity which owns a license issued under Title 4 of the Alaska Statutes. PASSED AND APPROVED this day of 1984 by 'the Borough Assembly.
