1984-11 Adopting a Conflict-Of-Interest Provision.7 h ' Sections: KODIAR ISLAND BOROUGH ORDINANCE NO. 84 -11 -0 AN ORDINANCE OF THE KODIAR ISLAND BOROUGH ASSEMBLY ADOPTING A CONFLICT -OF- INTEREST PROVISION. WHEREAS, Alaska Statutes 29.23.555 requires each home rule and general law municipality to adopt a conflict -of- interest i I ordinance which includes provisions that an officer or employee l shall disqualify himself from participating in any official action i in which he has a substantial financial interest. NOW, THEREFORE, BE IT ORDAINED that Section 2.18 of the ; Kodiak Island Borough Ordinances is amended by adding a new i section to read as follows: Chapter 2 . CONFLICT OF INTEREST 2.18.010 Conflicts of interest prohibited. 2.18.020 Definitions 1 2.18.010 Conflicts of interest prohibited. A. A municipal 1 officer, appointed official or employee may not solicit or receive money for advice or assistance given in the course of the Il officer's or employee's employment or relating to his employment. li B. A municipal officer, appointed official or employee may not represent a client before the Borough assembly or the Borough i planning and zoning commission for a fee. C. A municipal officer, appointed official or employee ma 1 not accept a gift, loan, gratuity or other valuable consideration, or a promise of any of them, with the understanding or agreement, expressed or implied, that the office will cast a vote or give an opinion, decision or judgment in a particular manner, in a matter, question, cause or proceeding which then is or may by law come or be brought before him, or with the understanding or agreement that the officer or employee will, in his official capacity, act in a particular manner to produce or prevent a particular result. D. No municipal officer or employee may vote or participate in any official action in which he has a substantial direct or indirect financial interest. Direct or indirect financial interes shall be disclosed to the presiding officer prior to a vote on the question, and if there are not at least four assemblymembers in attendance, who are qualified to vote, the matter shall be tabled until the next regular or special meeting at which four assembly - members qualified to vote on the matter are in attendance. E. A municipal officer or employee may not use his official position for the primary purpose of obtaining financial gain for himself, or his spouse, child, mother, father, or business with which he is associated or owns stock. 2.18.020. Definitions. As used in this chapter, the following definitions shall apply: A. "Municipal Officer" means the mayor, the Borough manager, Borough assembly members, and members of the Borough planning and zoning commission.
