ORDINANCE NO. 83 -67 -0
AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY ESTABLISHING
GENERAL PROCEDURES AND FEES IN RELATION TO LAND SALES.
WHEREAS, the Kodiak Island Borough maintains a Land Sale Fund
established by Ordinance No. 83 -24 -0, passed and approved on April 7, 1983,
ratifying the existence and continuance of such fund, and
WHEREAS, the Kodiak Island Borough does periodically have sales of
land to the public by auction, and
WHEREAS, the terms of the sales are peculiar to a particular sale,
and
WHEREAS, in the past the Borough has experienced numerous late
payments on installment payments for said land agreements.
NOW, THEREFORE, BE IT ORDAINED by the Assembly of the Kodiak Island
Borough that the following provisions will apply to all sales of public lands
by the Kodiak Island Borough, effective the date of enactment of this
ordinance.
3.04.56 Penalties. The following provisions shall apply to all land
sale agreements entered into by the Kodiak Island Borough following the
enactment date hereof:
a. Late Payment Fees. All payments made to the Borough pursuant
to any land sale contract or deed of trust note not made within fifteen (15)
days of the due date will be deemed to be late, and all such late payments
shall be assessed a late payment fee of 4% of the payment per occurrence.
