1983-48 Amending Chapter 4.15 of the Borough Code Pertaining to Service Boardsfl TTEST: ..r.ug Wet- I 1 5 a� KODIAK ISLAND BOROUGH ORDINANCE NO. 83 -48 -0 AN ORDINANCE OF THE KODIAK ISLAND BOROUGH AMENDING ;,CHAPTER 4.15 OF THE BOROUGH CODE PERTAINING TO SERVICE BOARDS. WHEREAS, AS 29.28.040 requires candidates in a municipal !election to receive in excess of 40 percent (40%) of the votes cast for his /her respective office; and WHEREAS, elected boards for service areas are the (creation of the Assembly and not a constitutional or statutory requirement and WHEREAS, the definition of municipal election contained AS 29.78.010 (7) does not include election boards for service I ('areas ; NOW, THEREFORE, BE IT ORDAINED by the Kodiak Island ,Borough Assembly as follows: Section 4.15.020 is amended to read as follows: "4.15.030 Term. Composition, appointment, election, qualifications. A Board of supervisors shall con- sist of three members, or more, as the assembly may determine by ordinance. The initial members of the board shall be appointed by the assembly to serve until the expiration of their terms as set forth in Section 4.15.030. Thereafter, members of the board of supervisors shall be elected by the qualified voters within the service area at a regular election. Vacancies shall be filled by the candidate(s) re- ceiving the highest number of the votes cast for each seat. Each board member shall be qualified to vote within the borough and shall be a resident of the service area." ection 4.15.030 is repealed and reenacted to read as follows: "4.15.030 Term. Initial members shall be appointed by the Mayor and ratified by the Assembly until the next regular election; at which time their terms shall be divided substantially into thirds, so as to have terms of one, two and three years, respec- tively, so the terms of the board members will be staggered. Thereafter, terms will be for three years. PASSED AND APPROVED THIS 7th DAY OF July , 1983.
