AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY ENACTING
CHAPTER 9.20 OF THE BOROUGH CODE ENTITLED PEACE OFFICERS.
The Kodiak Island Borough Assembly Hereby Ordains:
SECTION 1: Chapter 9.20 of the Borough Code is enacted ro read as follows:

Section 9.20.010 Authority. The Borough Manager may in writing
designate one or more employees of the Borough as peace officers with the
authority to issue citations; conduct investigations of violations of and en-
force the Borough Code, Ordinances and Regulations; and to take other action
consistent with the exercise of these enumerated powers when necessary to
enforce the Borough Code, Ordinances and Regulations and maintain the public
peace.
Section 9.20.020 Interference with a Peace Officer. No person
may interfer with a peace officer while he is in the performance of his
duties. A person who does any of the following is guilty of interfering with a
peace officer:
A. By use or threat of force or violence, he prevents or attempts
to prevent a peace officer from carrying out his duties;
B. By use or threat of force or violence he attempts to aid or
aids a person in preventing a peace officer from carrying out his duties; or
C. With intent to delay or prevent a peace officer from dis-
charging the officer's lawful duties, he in any manner physically impedes or
hinders the peace officer.
Section 9.20.030 Penalty. A person who interfers with, unlawfully
assaults or threatens, or unlawfully strikes or wounds a peace officer while he
is performing his duties is guilty of a misdemeanor, punishable by a fine of
not more than $500, or by imprisonment in jail for not more than 30 days, or by
both.
SECTION 2: This ordinance shall be effective immediately upon passage and
approval by the Kodiak Island Borough Assembly.
