1983-17 Amending Title 17, Deleting Chapter 17.18, Residential Zones & Creating Chapter 17.18, Single Family Residential District, Chapter 17.19, Two- Family Residential District, and Chapter 17.20, Multi-Family Residential Districtn fl n AN ORDINANCE OF THE BOROUGH ASSEMBLY AMENDING TITLE 17 OF BOROUGH CODE, BY DELETING CHAPTER 17.18, RESIDENTIAL ZONES AND CREATING CHAPTER 17.18, SINGLE - FAMILY RESIDENTIAL DISTRICT, CHAPTER 17.19, TWO- FAMILY RESIDENTIAL DISTRICT, AND CHAPTER 17.20, MULTI - FAMILY RESIDENTIAL DISTRICT. The Kodiak Island Borough Assembly Hereby Ordains that: SECTION 1: Chapter 17.18, Residential Zones, is repealed and deleted. SECTION 2: Chapter 17.18, Single - Family Residential District, is hereby enacted to�read as follows: CHAPTER 17.18 R1- SINGLE - FAMILY RESIDENTIAL DISTRICT SECTIONS: 17.18.010 Description and Intent 17.18.020 Permitted Uses 17.180030 Conditional Uses 17.18.040 Area Requirements 17.18.050 Yards 17.18.060 Building Height Limit 17.18.070 Public Service Requirement 17.18.010 Description and Intent. The Single - Family Residential District is established as a land use district for small lot single family residential dwellings where public water and sewer services are available. For the Single - Family Residential District, in promoting the general purposes of this Title, the specific intentions of this chapter. are: A. To encourage the construction of single - family dwellings; B. To prohibit commercial and industrial land uses and any other use! of the land which would interfere with the development or continuation of single - family dwellings in the district; C. To encourage the discontinuance of existing uses that are not permitted under the provisions of this Chapter; D. To discourage any use which would generate other than normal vehicular traffic on streets serving residents on those streets; and create requirements for public such c as r police o and�fire wouldi protection, water supply and sewerage, before such service can systematically and adequately be provided. 17.18.020 Permitted Uses. The following land uses are permitted in the Single - Family Residential District: A. Accessory buildings; B. Churches; C. Greenhouses; D. Parks and playgrounds; and H. Single - family dwellings. KODIAK ISLAND BOROUGH ORDINANCE NO. 83 -17 -0 S 17.18.030 Conditional Uses. The following land uses may be allowed by obtaining a conditional use permit from the Planning and Zoning Commission: A. Home occupations; B. Hospitals; and C. Schools. 17.18.040 Area Requirements. A. Lot Area. The minimum lot area required in 7,200 square feet. B. Lot Width. The minimum lot width required is 60 feet. 17.18.050 Yards. A. Front Yard. 1. The minimum front yard shall be twenty -five feet unless a previous building line less than this has been established, in which case the minimum front yard for interior lots shall be the average of the setbacks of I the main structures on abutting lots on either side if both lots are occupied. 2. If one lot is occupied and the other vacant, the setback shall be the setback of the occupied lot plus one -half the remaining distance to the required twenty- five -foot setback. 3. If neither of the abutting side lots or tracts are occupied by a structure, the setback shall be twenty -five feet. B. Side Yards. The minimum yard required, on each side of a principal building, is 10 percent of the lot's width but need not exceed 25 feet. The minimum required side yard on the street side of a corner lot is 10 ; feet. C. Rear Yard. The minimum rear yard required is 25 percent of the lot's depth but nednot exceed 25 feet. 17.18.060 Building Height Limit. The maximum building height allowed, 35 feet. 17.18.070 Public Service Requirement. Water and sanitary sewer service from a certificated public utility or municipal system are required for lots in this land use district before a building permit can be issued. SECTION 3: Chapter 17.19, Two - Family Residential District, is hereby enacted to read as follows: SECTIONS: 17.19.010 Description and Intent 17.19.020 Permitted Uses 17.19.030 Area Requirements 17.19.040 Yards 17.19.050 Building Height Limit 17.19.060 Public Service Requirement Kodiak Island Borough Ordinance No. 83 -17 -0 Page 2. CHAPTER 17.19 R2 -TWO- FAMILY RESIDENTIAL DISTRICT 17.19.010 Description and Intent The Two - Family Residential District is 1 established as a land use district for single and two- family residential �II 01 I 1 dwellings and limited office uses where public water and sewer services are available. For the Two - Family Residential District, in promoting the general purposes of this Title, the specific intention of this chapter are: A. The following land uses are permitted in the Two - Family Residential District: A. Accessory buildings; B. Beauty shops; C. Churches; D. Clinics; E. Greenhouses; F. Home occupations; G. Hospitals; H. Parks and playgrounds; I. Professional offices; J. Schools; K. Single - family dwellings; and L. Two - family dwellings. 17.19.030 Area Requirements A. Lot Area. The following land uses are permitted in the Multi - Family Residential District: A. Accessory buildings; B. Beauty shops; C. Boardinghouses; D. Churches; E. Clinics; F. Greenhouses; G. Home occupations H. Hospitals; I. Multi- family dwellings; J. Parks and playgrounds; K. Professional offices; L. Schools; M. Single - family dwellings; and N. In the case of a dwelling group consisting of two or more buildings, the contemplated arrangement of which makes it impracticable to apply the requirements of this Title to the individual building units in the group, a conditional use permit may be issued by the Planning Commission if the plans of such dwelling group comply with the following standards and the requirements of Chapter 17.67: A. That the proposed dwelling group will constitute a residential environment of sustained desirability and stability; that it will be in harmony with the character of the surrounding neighborhood; that it will result in intensity of land utilization no higher, and standards of open space at least as high, as permitted or specified in this Title in the district in which the proposed dwelling group is located; B.' That the tract of land on which the dwelling group is to be erected comprises at least eighty thousand square feet; C. That the buildings are to be used only for residential purposes and the customary accessory uses, such as garages, storage spaces and recreational and community activities; D. That the average lot area per dwelling unit on the side, exclusive of the area occupied by streets, will not be less than the lot area required for each dwelling unit in the district in which the dwelling group is to be located; E. That there are provided, as part of the proposed development, adequate recreation areas to serve the needs of the anticipated population; F. That off - street parking is provided on the basis of two parking spaces for each dwelling unit within the development; G. That the development will not produce a volume of traffic in excess of the capacity for which the access streets are designed; H. That property adjacent to the proposed dwelling group will not be adversely affected; I. That such dwelling group not be located in an industrial district; and J. That the proposed group housing development will be consistent with the intent and purpose of this Title to promise public health, safety and general welfare. 17.20.080 Site Plan Requirement. All multi - family developments containing ten or more dwelling units shall provide a site plan containing the information required by Section 17.67.030 of this Title. Said site plan shall be reviewed and approved by the Planning Commission prior to the issuance of a building permit. SECTION 5: That this ordinance shall be in full force and effect upon passage and adoption.
