1983-15 Deleting Chapter 17.12, Rural Residential Zones, and Enacting Chapter 17.17, Rural Residential DistrictKODIAK ISLAND BOROUGH ORDINANCE NO. 83 -15 -0 AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY DELETING CHAPTER 17.12, RURAL RESIDENTIAL ZONES, AND ENACTING CHAPTER 17.17, RURAL RESIDENTIAL DISTRICT. The Kodiak Island Borough Assembly hereby ordains that: SECTION 1: Chapter 17.12, Rural Residential zones, is repealed in its entirety. SECT IO N 2: Chapter 17.17, Rural Residential District, is created to read as follows: CHAPTER 17.17 RR1 - RuR471TESTUERTIXE DISTRICT SECTIONS: 17.17.010 Description and Intent 17.17.020 Permitted Uses 17.17.030 Conditional Uses 17.17.040 Area Requirements 17.17.050 Yards 17.17.060 Building Height Limits 17.17.010 Description and Intent The Rural Residential District is established as a land use district for large lot, low density, residential and general agricultural purposes. For the Rural Residential District, in promoting the general purposes of this•Title, the specific intentions of this Chapter are: A. To encourage the continued use of land for low density residential and general agricultural purposes; B. To prohibit commercial and industrial land uses; C. To encourage the discontinuance of existing uses that are not permitted under the provisions of the Chapter; and D. To discourage land uses which, because of their character or size, would create unusual requirements and costs for public services. 17.17.020 Permitted Uses. The following land uses are permitted in the Rural Residential District: A. Accessory buildings; B. Agricultural buildings and activities; C. Churches; D. Fishing activities when an owner- occupied dwelling is present on the premises; E. Greenhouses; F. Horticultural buildings and activities; and G. Single family dwellings. 17.17.030 Conditional Uses. The following land uses may be allowed by obtaining a conditional use permit from the Planning and Zoning Commission: A. Home occupations; and B. Fireworks stands. 1,7.17.040 Area Requirements. A. Lot Area. The minimum lot area required is 40,000 square feet. B. Lot Width. The minimum lot width required is 120 feet. 17.17.050 Yards. A. Front Yard. The minimum front yard required is 25 feet. B. Side Yards. The minimum yard required, on each side of a principal building, is 10 percent of the lot's width. The minimum side yard required on the street side of a corner lot is 25 feet. C. Rear Yard. The minimum rear yard required is 25 percent of the lot's depth but neednot exceed 40 feet. 17.17.060 Building Height Limits. The maximum height of residential buildings shall not exceed 35 feet. SECTION 3: This Ordinance shall be in full force and effect upon passage and adoption.
