KODIAK ISLAND BOROUGH
ORDINANCE NO. 83- 11 -0(A)
AN ORDINANCE OF THE KODIAK ISLAND BOROUGH REVISING SECTIONS 16.04.130
AND 16.28.020 OF THE KODIAK ISLAND BOROUGH CODE PERTAINING TO THE DEFINITION OF
SUBDIVISION.
WHEREAS, the current wording of Section 16.04.130C leads people to
believe that the sale or exchange of small parcels to or between adjoining
property owners does not require preparation and submission of a plat, and
WHEREAS, Section 16.28.020 does specifically require submission of
a plat that meets the minimum final plat requirements.
NOW, THEREFORE, BE IT ORDAINED by the Kodiak Island Borough Assembly
that Section 16.04.130C and Section 16.28.020 are revised as follows:
Section 16.04.130C Resubdivision of land heretofore divided or platted
in lots, sites or parcels, provided, however, that the sale or exchange
of small parcels of land to or between adjoining property owners where
shish sale OP exchange does net create additional lots, shall not be
considered as a subdivision of land, shall be subject to the provisions
of Section 16.28.020.
Section 16.28.020 Platting. Where small parcels of land to or between
adjoining property owners are sold or exchanged, where such sale or
exchange does not create additional lots, and therefore is net considered
a subdivision of lagd, a plat shall be submitted that shall eea+ply with
the minimum of final plat requirements, a plat that shall comply with the
minimum of final plat requirements shall be submitted for review and
approval l the Borough Engineer and does not have to be reviewed y the
Planning and Zoning Commission.
