KODIAK ISLAND BOROUGH
ORDINANCE NO. 82 -43 -0
AN ORDINANCE PROVIDING FOR A SPECIAL ELECTION IN THE
MONASHKA BAY ROAD SERVICE AREA. -
WHEREAS, Section 4.10.010 requires that any service
within a service area must be approved by a majority of the quali-
fied voters residing within the service area and voting on the
question, and
WHEREAS, the Assembly did pass Ordinance No. 82 -42 -0
establishing the Monashka Bay Road Service Area for the purpose
of providing road services within a specified area, and
WHEREAS, road service is necessary in the interest of
public safety.
NOW, THEREFORE, BE IT ORDAINED by the Kodiak Island
Borough Assembly that:
,Section 1. A special election shall be held on Tues., Jan. 11,1983
between the hours of 8 AM and 8 PM of said date and there shall be
submitted to the duly qualified residents and voters of Monashka
Bay Road Service Area the following proposition:
"Shall the Kodiak Island Borough exercise
road powers within the Monashka Bay Road
Service Area including but not limited to
road design, construction, maintenance
and administration for improvement of
public roads ?"

Section 2. Be it ordained that there is created by the Kodiak
Island Borough Assembly under 4.15.020 of the Borough Code an
elected advisory board of five (5) residents of the Monashka Bay
Service Area for the purpose of supervising and furnishing of
special services within the district. The initial term shall be
decided according to 4.15.020 of the Borough Code.
Section 3. A person who is qualified to vote in Alaska and the
Kodiak Island Borough and is a resident of the Monashka Bay Servicet
Area described in Ordinance No. 82 -42 -0 may vote in the election.
Section 4. The polling place for this election will be the East
Elementary School, Mission Road Precinct.
Section 5. Notice of the election shall be published not less
than thirty days prior to the election in the form and manner
provided by AS 29.38.050 and Title 2 of the Kodiak Island Borough
1 Code of Ordinances and Resolutions.
(Section 6. Upon passage of the proposition to exercise road
powers within the Monashka Bay Road Service Area by the qualified
voters of that area, and upon certification of said election, be
it ordained that providing of said service shall commence imme-
diately after said certification as per 4.10.040 of the Borough
Code of Ordinances.
