1982-42 Establishing the Monashka Bay Road Service Area for the Purpose Road Services Within a Specified Area.and safety. KODIAK ISLAND BOROUGH ORDINANCE NO. 82 -42 -0 AN OR DINANCE ESTABLISHING THE MONASHKA BAY ROAD SERVICE AREA FOR THE PURPOSE OF PROVIDING ROAD SERVICES WITHIN A SPECIFIED AREA. WHEREAS, Section 4.05.030 of the Kodiak Island Borough Code provides for establishment of service areas by petition of 25% of the real property owners within the boundaries of the proposed service area; and WHEREAS, a petition was filed with the Kodiak Island Borough Assembly) on October 7, 1982 at 9:30 p.m. by residents in the Three Sisters Way and Devils Prong areas of U.S. Survey 1678, requesting road services; and WHEREAS, the petition filed does not meet all of the requirements of Section 4.05.030; and WHEREAS, Section 4.05.040 of the Kodiak Island Borough Code provides for the Assembly to initiate a service area by introduction of an ordinance; WHEREAS, road services are necessary in the interest of public NOW, THEREFORE, BE IT ORDAINED by the Kodiak Island Borough Assembly that: Section 1. A service area to be known as Monashka Bay Road Service Area is hereby established to provide road services for the area described as follows: All of that portion of land lying within Section 20, Township.27urvey South, Range 19 West, Seward Meridian, Alaska, platted 1678, approved by Thomas C. Howell, Assistant Commissioner, General Land Office, Department of the Interior, on U.S 1929;Ex ce t the State of Alaska highway right -of -way lying within Contains: 147.93 acres, more or less. Section 2 Services. The Monashka Bay Service Area is established to provide for road design, construction and maintenance, including administration and collection costs of the same, for the area within its boundaries. Section 3 Management. The Monashka Bay Service Area shall be managed and operated by the Mayor and Assembly in the same manner as other Borough functions. Section 4 The Costs. A. The costs of providing road design, construction, maintenance, administration, and collection services, whether the service is provided by the Borough itself or by contract, shall be borne by the '1 property owners of both real and personal property having property within the boundaries of the service area. B. The Assembly is hereby authorized to levy taxes against all real G personal property lying and being within the boundaries of the service area to finance the Road Service. C. Road Service taxes are to be collected in the same manner and at the same time as other real and personal property due in the service area.
