1982-36 Amending Title 2 of the KIB Municipal Code by the Creation of Chapter 2.30 Providing for a Parks and Recreation CommitteeAN ORDINANCE OF THE KODIAK ISLAND BOROUGH AMENDING TITLE 2 OF THE KODIAK ISLAND BOROUGH MUNICIPAL CODE BY THE CREATION OF CHAPTER 2.30 PROVIDING FOR A PARKS AND RECREATION COMMITTEE. WHEREAS, the Kodiak Island Borough by Resolution No. 76 -45 -R authorized Proposition Number 2 stating: "Shall the Kodiak Island Borough assume and exercise the powers necessary to provide recreational facilities ? ", and KODIAK ISLAND BOROUGH ORDINANCE NO. 82 -36 -0 WHEREAS, the Kodiak Island Borough by Resolution 76 -54 -R ratified the results of Proposition Number 2 providing that the Kodiak Island Borough will exercise powers necessary to provide recreational facilities on a non - areawide basis, and WHEREAS, the Kodiak Island Borough by Ordinance No. 79 -9 -0 adopted a Comprehensive Parks and Recreation Plan on January 9, 1981. NOW, THEREFORE, BE IT ORDAINED by the Assembly of the Kodiak Island Borough, Alaska as follows: Section 1. Title 2 of the Kodiak Island Borough Municipal Code, Administra- tion and Personnel, is hereby amended by adding a new chapter to read as follows: Sections: Chapter 2.30 PARKS AND RECREATION COMMITTEE 2.30.010 Committee created - duties. 2.30.020 Appointment, terms and procedures. 2.30.030 Quorum. 2.30.040 Conflict of interest. 2.30.050 Administrative assistance. 2.30.010 Committee created - duties. There is established the Kodiak Island Borough Parks and Recreation Committee consisting of nine voting members who are residents of the Borough and represent a cross section of the social and economic structure of the community. The Committee is empowered to: A. Identify existing and future recreation demands including indoor and outdoor recreation; B. Evaluate existing and future recreation needs; C. Generate priorities and action plans including a capital improvement program for parks and recreation; and D. Review and recommend revisions as necessary to the adopted Comprehensive Parks and Recreation Plan. All such plans and recommendations shall be reviewed by the Planning and Zoning Commission prior to presentation to the Mayor and Borough Assembly. 2.30.020 Appointment, terms and procedures. Members of the Committee shall be appointed by the - Mayor, subject to confirmation by the Assembly. The Planning and Zoning member shall be chosen by the Planning and Zoning 11 , I 1 -! ') r 1 appointed for tl 2 -year terms, two for two -year .ms and two for one -year terms. One Assembly member and one Planning and Zoning commissioner shall be voting members of the committee. The City Parks and Recreation Director, the State Park Ranger, and a School Board representative shall be non - voting ex- officio members of the Committee and participate in all discussions and assigned duties. The Committee shall designate its chairman and other officers as provided in bylaws approved by the Assembly. No additions or changes may be made in the bylaws unless specifically approved by the Assembly. Meetings shall be public, except that executive session may be held in accordance with Section 2.16.120 of the Borough Code. The Committee shall meet at least monthly at times and places designated by the chairman, but meetings need not be held if no business is pending. The chairman or a majority of the Committee) may call a special meeting. The Committee shall give reasonable public notice of its meetings. Vacancies occur and are filled as provided in Section 2.16.060 of this title for Assembly members. 2.30.020 Quorum. A majority of the authorized membership is a quorum for the transaction of business. In the absence of a quorum, a lesser number may recess a meeting to a later time or date. 2.30.048 Conflict of interest. No member of the Committee may vote on any) question upon which he has a substantial direct or indirect financial interest. 2.30.050 Administrative assistance. The Borough Manager or his designee shall: A. Furnish the Committee with all requested documents and other information necessary for, or reasonably related to, Committee functions; B. Provide the Committee with supplies, meeting space and secretarial assistance as reasonably required; C. If feasible under the circumstances, refer to the Committee matters within its powers and duties, prior to presentation for Assembly action; and D. Transmit Committee recommendations and other communications to the Planning and Zoning Commission prior to review by the Assembly, provided; however, if no action has been taken by the Planning and Zoning Commission within thirty (30) days, it shall be deemed that approval has been given. Section 2. This ordinance shall be effective after its final passage and approvals by the Kodiak Borough Assembly. PASSED AND APPROVED this 7th day of October by the Kodiak Island Borough Assembly.
