1982-27 Amending Title 8 of the KIB Municipal Code, Entitled "Health and Safety" By the Enactment of a Revised Chapter 8.08, Creating a Mental Health Center Advisory Boardn n 1 j , 1 2 7 n KODIAK ISLAND BOROUGH ORDINANCE NO. 82- 27 -0(A) AN ORDINANCE OF THE KODIAK ISLAND BOROUGH, ALASKA, AMENDING TITLE 8 OF THE KODIAK ISLAND BOROUGH MUNICIPAL CODE, ENTITLED "HEALTH AND SAFETY," BY THE ENACTMENT OF A REVISED CHAPTER 8.08, CREATING A MENTAL HEALTH CENTER ADVISORY BOARD. WHEREAS, the Kodiak Island Borough has been active in the field of mental health through its support of the Kodiak Aleutian Mental Health Center and personnel associated with that center, and WHEREAS, the Assembly is convinced of the necessity and the desira- bility of mental health services for the people of Kodiak, and WHEREAS, in order to allow the Kodiak Island Mental Health Center to formulate appropriate applications for funding and make recommendations to the Assembly, and WHEREAS, in order to provide an authorization for said activities. NOW, THEREFORE, BE IT ORDAINED by the Assembly of the Kodiak Island Borough, Alaska, as follows: Section 1. Title 8 of the Kodiak Island Borough Municipal Code, "Health and Safety," is hereby amended by eliminating existing Chapter 8.08 in its entirety and substituting the following: CHAPTER 8.08 MENTAL HEALTH CENTER ADVISORY BOARD Sections: 8.08.010 Created -- Membership. 8.08.020 Term -- Compensation. 8.08.030 Powers and Duties. 8.08.040 Administrative Assistance. 8.08.050 Status of Employees. 8.08.010 Created -- Membership. There is created a mental health center advisory board which shall consist of seven borough residents appointed by the mayor subject to confirmation by the assembly. The mayor and one assembly member shall be voting members of the board. The mental health director shall serve as an ex- officio member of the board and the mayor may, with the concur- rence of the assembly, appoint additional ex- officio members. The board shall designate its chairman and other officers as provided in bylaws approved by the assembly. No additions or changes may be made in the bylaws unless specifically' approved by the assembly. 8.08.020 Term -- Compensation. A. The members shall serve for three years and until their successors are appointed and qualify; however, of the members first appointed, three shall be appointed for three years, two for two years, and two for one year. Appointment to fill vacancies shall be for the unexpired term only. B. Members of the board shall serve without compensation. 8.08.030 Powers and Duties. The board shall serve in an advisory capacity' to the Kodiak Island Borough Assembly with regard to management and operation of the Kodiak Aleutian Mental Health Center. In that capacity the board is requirelt to: n , 1 , i 7 A. Hold public meetings at least once per month at a time and place within the borough designated by the chairman of the board; B. Receive testimony and otherwise investigate matters of concern with regard to mental health; C. Provide advice to the assembly and borough manager on all matters pertaining to the work conducted by the Mental Health Center; D. Review the proposed annual budget, evaluate grants and other funding proposals, and make reccmnendations with regard to financial matters affecting mental health services, salaries and facilities; E. Maintain full and complete surveillance of the Mental Health Center and its operation and affairs on behalf of the assembly, and perform such duties from time to time as may be delegated by resolution of the assembly, provided that the assembly specifically reserves to itself approval of all budgets, contracts, expenditures or indebtedness of any kind; F. Provide advice and recommendation to the assembly on staff, equipment and personnel requirements of the Mental Health Center; G. Review and propose health policies, programs and long range health planning for the prevention and treatment of emotional illness in the borough. 8.08.040 Administrative Assistance. The borough manager or his designee shall: A. Furnish the board with copies of all requested documents and other information necessary or reasonably related to the performance of board functions; B. Provide the board with such supplies, meeting space, and secretarial assistance as the manager deems reasonably required; C. Refer to the board for their consideration all non - emergency matters within the scope of its powers and duties prior to presenting those matters to the assembly for action; D. Transmit all recommendations and other communications frcn the board to the assembly; E. Provide all necessary accounting services including receipt of funds, payment of expenditures, et cetera necessary for the accurate financial operation of the Mental Health Center. 8.08.050 Status of Employees. Employees of the Kodiak Aleutian Mental Health Center shall be deemed employees of the borough for all purposes, except that the mental health advisory board may adopt personnel rules and regulations with respect to employees of the center. Such rules and regulatior shall include a pay plan and schedule, standards for such a plan, provisions for salary increases and a detailed job description and salary range for each position. Such rules and regulations shall be effective only upon approval by the assembly. No additions or changes may be made without specific assembly approval. Any salary adjustment must be approved by the assembly. The borough manager, with concurrence of the board, is responsible for hiring and firing the director. The director is responsible for hiring and firing all other staff associated with the Mental Health Center. With respect to matters not covered by such approved rules and regulations, the Kodiak Island Borough Code of Personnel Rules and Regulations shall apply to said employees. Section 2. This ordinance shall be effective after its final passage and approval by the Kodiak Island Borough. PASSED AND APPROVED this 5th day of the Kodiak Island Borough Assembly.
