Code, Providing for the Establishment and Operation of the Mental Health Center Governing Board0 1 1 -, 2 9 7 7 KODIAK ISLAND BOROUGH ORDINANCE NO. 80 -23 -0 AN ORDINANCE ENACTING CHAPTER 8.08 OF THE KODIAK ISLAND BOROUGH CODE, PROVIDING FOR THE ESTABLISHMENT AND OPERATION OF THE MENTAL HEALTH CENTER GOVERNING BOARD. The Kodiak Island Borough Assembly ordains: Section 1. Chapter 8.08 is added to the Kodiak Island Borough Code as follows: CHAPTER 8.08 MENTAL HEALTH CENTER GOVERNING BOARD Board Established There is a Mental Health Center Governing Board. The Board shall have the powers and duties prescribed in this chapter. Composition, Appointment, Qualifications The Mental Health Center Governing Board shall consist of nine members. Members of the Board are appointed by the Mayor, . subject to Assembly confirmation. Each board member shall be qualified to vote within the Borough. Term A board member's term shall be for three years, and until his successor is appointed and qualifies; provided that an unexpired term that began before the effective date of this chapter shall continue until the time provided for its expiration when it began. After serving two consecutive terms, a board member may not be reappointed until one year after the end of his last term. Vacancies A. A vacancy on the Board shall be filled by appoint- ment of the Mayor, subject to Assembly confirmation, for the remainder of the term of the former member. B. A vacancy occurs when: 1. An appointed candidate fails to qualify and assume the duties of the office within thirty days of Assembly confirmation; In A , 1 11. 1 I the Assembly; 2 q t, 2. A member departs the Borough intending to remain outside the Borough for ninety days or more; 3. A member submits a resignation accepted by 4. A member fails to attend Board meetings for ninety days or more; 5. A member is absent from three consecutive regular Board meetings without the Board excusing any such absence; 6. A member ceases to be qualified under Section 8.08.020. Compensation Board members shall be compensated as provided by resolution of the Assembly. Officers The Board annually shall select from its membership a chairman, vice chairman, recording secretary and corresponding secretary. The chairman shall preside at the meetings of the Board, and shall represent the Board as directed by its membership. The vice chairman shall act in the absence of the chairman. The officers shall perform such additional duties as the Board may prescribe. Meetings, Quorum A. The Board shall hold a regular meeting monthly, or more frequently in accordance with the Board's by -laws. The chairman or three board members may call a special meeting of I the Board. B. A majority of the authorized membership of the Board constitutes a quorum. All Board actions shall be by vote ;,of a majority of the Board's authorized membership. 1 By -Laws The Board may adopt its own written by -laws, consistent with this chapter, governing the conduct of its proceedings and Ord. In all matters of procedure not governed by such by -laws or this chapter, Robert's Rules of Order, Newly Revised, shall govern. 1 Powers and Duties The Mental Health Center Governing Board shall have the following powers and duties: A. Under the general supervision of the Assembly, the Board shall maintain and operate a community mental health center for the Kodiak Aleutian area, for the purpose of conducting a program for the prevention and treatment of emotional illness and promoting other social service programs. B. The Board shall report to the Assembly regarding its operations under A of this section, and shall advise the Assembly regarding community mental health issues. Section 2.
