WHEREAS, the Assembly finds it necessary for theprotection of the
Sdfety and welfare of residents of the community to limit the height of struct-
u res to prevent there conflicting. with air navigation.
THE KODIAK ISLAND BOROUGH ASSEMBLY HEREBY ORDAINS AS FOLLOWS:
Section 1: The Kodiak Island Borough Code of Ordinances is hereby amended by
providing a new subsection 17.40.010 t0 read as follows:
17.40.010 Airoort Height Limitations Authorized:

17.40.020 Str6ctures Exceeding Height Limitations Prohibited:
No persons may construct or alter any structure or earth fill so
that its height exceeds any height limitation established under thi
chapter./ Where an airport height limitation applies to property th
is subject to another height limitation under this title or other
applicable law, the more restrictive limitation shall govern the us
of the property.
17.40.030 Specifications - Approach and Side -Slope Zones:
A. There shall be an approach zone at each end of the runway. The
inner edge of an approach zone shall coincide with the end of the
primary surface of the runway. The inner edge of the approach zone
is two hundred fifty (250) feet wide. The approach zone is horizont
ally centered on the longitudinal centerline of the runway and ex-

(1,250) feet at a horizontal distance of five thousand (5,000) feet
from the end of the primary surface. The height limitation in th(
approach zone is at the primary surface level at the edge of the
primary surface and rises one (1) foot vertically for each forty (40
feet of horizontal distance from the edge of the primary surface or
steeper where conditions provide no approach zone it may exceed a
ratio of 20 to 1.
B. Primary Surface. A surface longitudinally centered on the run-
way. The primary surface extends two hundred (200) feet beyond both
ends of a runway. The width of the primary surface will be one
hundred (100) feet plus the runway width. The elevation of any
point on the primary surface is the same as the elevation of the
nearest point on the runway centerline.
C. Map. The airport approach and side -slope map shall be drawn to
scale and shall graphically depict the limits of the approach zones
and side -slope zones for each runway. The map shall indicate the
elevation of the base of the approach and side -slope zones at
vertical intervals of five (5) and ten (10) feet, respectively. 1.
map shall also depict the topography of the existing runway surface
and land below the approach and side -slope zones.
D. There shall be a side -slope zone at each side of the runway.
The inner edge of the side -slope zone coincides with the edge of the
primary surface of both sides of the runway. The sides of the side-
slope zone coincide with the sides of the adjacent approach zone.
The height limitation in the side -slope zone is at the primary sur-
face and rises one (1) foot vertically for each seven (7) feet of
horizontal distance commencing at the edge of the primary surface.
E. If the Assembly finds that there is an area in a side -slope
zone within which topography, combined with the height limitation of
the side -slope zone, will prevent any reasonable use of the land,
the Assembly may modify the geight limitation for that area specifie
under B. of this section, to allow the reasonable use of the land
consistent with safe aviation practice. In no event, however, sl
such a modification allow a maximum structure height exceeding thirt
five (35) feet.
F. For the purpose of this chapter the primary surface of a runway

hundred (200) feet beyond each end of the runway and fifty (50)
feet beyond each side of the runway. The elevation of a point on
the primary surface of the runway shall equal the elevation of the
nearest point on the longitudinal enterline of the runway.
17.40.040 Height Restrictions:
A. No structure may be built, altered, reconstructed or land filled
within the primary surface or beneath the airport approach and side -
slope zones which would cause the structure or earth fill to pene-
trate into said airport approach and side -slope zones. In those
instances where other sections of this Title are in conflict with
the provisions of this section the provisions of this section
shall govern.
