AN ORDINANCE CALLING FOR THE ESTABLISHMENT
AND PROVISION OF SPECIAL SERVICES FOR SEWER, WATER
AND ROADS IN SEWER DISTRICT ONE OF THE MILL BAY - MONASHKA
SERVICE AREA.
BE IT ORDAINED by the Assembly of the Kodiak
Borough as follows:
SECTION 1. Chapter 2.36 is hereby amended by
adding a new section to read as follows:
Service District I of the Mill Bay - Monashka
Service Area.
A. Service District I of the Mill Bay -
Monashka Service Area is hereby created pursuant to
Alaska Statutes 29.63.090 as a special service district
within the Mill Bay - Monashka Service Area for the pro-
vision of sewer, water and road services.
B. Service District I of the Mill Bay -
Monashka. Service Area shall consist of and encompass the
following area:
Lands surveyed and unsurveyed lying within the following
described exterior boundary; beginning at corner #2 of USS
2538 -A thence N 55° 21' E 61.152 chains to a point
which is the most westerly corner of Tract A of USS
2538 -A the true point of beginning: thence N 55° 21' E
34.688 chains to corner No. 3 USS 2538 -A and common to
corner #3 of USS 3468; thence N 85° 27' E 11.308 chains
to corner No. 4 of USS 3468 and common to corner No. 4 of
USS 3467; thence N 23 54' E 37.879 chains to corner No. 5
of USS 3467 and common to corner No. 1 of Tract B USS 3465;
thence N 12 39' E 12.337 chains to corner No. 2 Tract B
USS 3465 and common to corner No. 4 USS 3104; thence N

across Miller Point Road (Monashka Bay Road) approximately
100 feet to the northwesterly corner of Lot 2 Block 5
Miller Point Alaska Subdivision; thence northeasterly
along the southerly and easterly side of Cliffside Loop
Road approximately 1212. feet to the northwesterly corner
of Lot 17 Block 1 Second Addition Miller Point Alaska
Subdivision; thence S 73° 01' E 342.41 feet to the mean
high tide line of Mill Bay; thence proceeding in a south-

westerly dire along the mean high tide line along
Mill Bay and thence continuing easterly, southerly and
westerly around Spruce Cape along the mean high tide line
approximately 4 -1/2 miles to a point common to Meander
corner No. 1 of USS 3066A & B; thence N 32° 24' W 2.42
chains to corner No. 2 of USS 3066A & B; thence N 42° 43'
E 0.54 chains to corner No. 3 of USS 3066A & B; thence N
37° 44' W 4.945 chains to corner No. 4; thence N 55° 16' E

to the southwesterly corner of Tract A USS 2538A; thence
N 34° 39' W 20.11 chains to a point on the 2 -3 line of
USS 2538 -A the true point of beginning; excluding those
portions lying with the corporate boundary of the City of
Kodiak as e':isting on Tanuary 1, 1978.
C. Within Service District I of the Mill
Bay - Monashka Service Area, the Borough shall have all
powers necessary to
1. Provide sewer services, including
but not limited to powers to construct, maintain, repair
and replace public sewage collection, transmission,
treatment and disposal systems and facilities;
2. Provide water services, including
but not limited to powers to construct, maintain, repair
and replace public water production, collection, storage,
treatment and transmission systems and facilities;
3. Provide road services, including but
not limited to, powers to construct, repair, maintain
and improve public roads;
4. Establish charges for provision of
water and sewer services and to tax and issue bonds to
fund such sewer, water and road services.
SECTION 2. Enactment of this Ordinance
shall be effective upon approval of this Ordinance by a
majority of the qualified voters residing within
Service District I of the Mill Bay - Monashka Service Area
and voting on the provisions of proposed Section 2.36.030
(C) (1) -(3) at the special election proposed by the
Borough Resolution Number 78 -18 -R.
