AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY REZONING
LOTS 4, 5, 6, 7, 8 AND 9, BLOCK 1, SOUTHEAST ADDITION AND LOT 5, TOLBERT
SUBDIVISION AND LOTS 10 AND 1, BLOCK 1, SOUTHEAST ADDII LON, USS 2910 -ABTO
BE DESIGNATED R -2 (Russell Gallagher and John Gibbons)
WHEREAS, Alaska Statutes 29.33.090 empowers the Borough to
enact a Zoning Ordinance and provide for its administration, enforcement and
amendments, and
WHEREAS, the Kodiak Island Borough has pursuant thereto
adopted Title 17, of its Code of Ordinances and Resolutions which provides
for planning and zoning provisions and procedures, and
WHEREAS, according to the Comprehensive Planning and Zoning
Map adopted by the Kodiak Island Borough that Lots 4, 5, 6, 7, 8 and 9,
Block 1, Southeast Addition and Lot 5, Tolbert Subdivision and Lots 10 and 1,
Block 1, Southeast Addition, USS 2910 -AB have been zoned R -1, and
WHEREAS, a petition has been received from Russell Gallagher
and John Gibbons requesting that same be rezoned from R -1 to R -2 to allow
for future development, and
WHEREAS, the petition was considered and approved by the
Planning and Zoning Commission on April 20, 1977, and said body has re-
commended the reclassification of said property from R -1 to R -2.
NOW, THEREFORE, BE IT ORDAIN by the Borough Assembly of
the Kodiak Island Borough that the property described as Lots 4, 5, 6, 7, 8
and 9, Block 1, Southeast Addition and Lot 5, Tolbert Subdivision and Lots
10 and 1, Block 1, Southeast Addition, USS 2910 -AB be and the same are hereby
reclassified as R -2 and that notice of the ordinance be given by publication
in the Kodiak Mirror seven (7) days prior to the second reading and that a
public hearing be held thereon on the date of the second reading, and that
this ordinance become effective at the time of adoption.
