1977-02 Rezoning Russell Estates, Third Addition, A Portion of USS 1396 to be Designated R-3. (L.L. Russell)KODIAK ISLAND BOROUGn ORDINANCE NUMBER 77 -2 -0 AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY REZONING RUSSELL ESTATES, 3rd ADDITION, A PORTION OF U.S.S. 1396 TO BE DESIGNATED R -3 (L. L. Russell) WHEREAS, Alaska Statutes 29.33.090 empowers the Borough to enact a Zoning Ordinance and provide for its administration, en- forcement and amendments, and, WHEREAS, the Kodiak Island Borough has pursuant thereto adopted Title 17, of its Code of Ordinances and Resolutions which provides for planning and zoning provisions and procedures, and, WHEREAS, according to the Comprehensive Planning and Zoning Map adopted by the Kodiak Island Borough, that Russell Estates, 3rd Addition, a portion of U.S.S. 1396, has been zoned Unclassified, and WHEREAS, a petition has been received from L. L. Russell requesting the same be rezoned from Unclassified to R -3 to allow for future development, and, WHEREAS, the Petition was considered and approved by the Planning and Zoning Commission on January 19, 1977, and said body has recommended the reclassification of said property from Unclassified to R -3, NOW, THEREFORE, BE IT ORDAINED by the Borough Assembly of the Kodiak Island Borough that the property described as RUSSELL ESTATES, 3rd ADDITION, A PORTION OF U.S.S. 1396 be and the same are hereby reclassified as R -3, and that notice of this Ordinance be given by publication to the Kodiak Mirror seven (7) days prior to the public hearing held on February 3, 1977, that this Ordin- ance become effective at the time of adoption.
